SUBJECT:

Approval of a Grant of an Avigation Easement from the City of San Carlos and Authorization for the County Manager to Accept Future Avigation Easements on Behalf of the County - San Carlos and Half Moon Bay Airports

 

Recommendation

Adopt a resolution which authorizes:

 

a)

the President of the Board to accept an avigation easement from the City of San Carlos (City) for the San Carlos Airport (Airport); and

 

b)

the County Manager to accept future avigation easements as may be offered for the San Carlos and Half Moon Bay Airports.

The proposed agreement allows for the compatible development of land in the vicinity of the Airport while ensuring the safe and efficient operation of the Airport as a viable element of the local, regional, state and national air transportation systems.

 

Background

Previous Board Action

Authorized the acceptance of similar avigation easements in the past between various property owners and the County.

 

History

The City owns 800 Brittan Avenue and has proposed a two-story office light industrial building (30,000 sq. ft.) on the property. The property is located within the Avigation Easement Review Area (AERA) boundary for the Airport, as described in the San Mateo County Comprehensive Airport Land Use Plan (CLUP), as amended, for San Carlos Airport. The CLUP is prepared and adopted by the City/County Association of Governments of San Mateo County (C/CAG), in its role as the state-mandated airport land use commission for the county.

   

The AERA was established by the San Mateo County Airport Land Use Commission and C/CAG pursuant to the State Aeronautics Act to protect the airspace in the vicinity of the Airport for the safe passage of aircraft in flight, and to notify owners of property near the Airport of the proximity of the Airport and of the potential impacts that could occur on their property from airport/aircraft operations.

 

Discussion

The proposed avigation easement provides for the free and unobstructed flight of aircraft over and across the airspace of the property and notifies the current and future owners of the property that it is located in the vicinity of the Airport and may be subject to the impacts of aircraft operations.

 

The proposed resolution also authorizes the County Manager to accept future avigation easements as may be offerred to the County for the San Carlos and Half Moon Bay Airports.

 

A resolution and agreement has been approved as to form by County Counsel and the City has agreed to return a signed copy of the agreement to the County Manager once it is executed by the City.

 

Fiscal Impact

There is no impact to the General Fund or any other fund of the County associated with accepting the Avigation Easement.
