Resolution of Application by the Scenic Heights County Sanitation District Requesting the Local Agency Formation Commission’s Approval for Extension of Sewer Service Outside Jurisdictional Boundaries Pursuant to Government Code Section 56133

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, acting as the governing Board of the Scenic Heights County Sanitation District (Scenic), that

WHEREAS, Scenic has been requested to provide sewer service to properties owned by Russell Gronsky (“Owner”) at 1508 and 1510 Edgewood Road (APNs 051-151-270 & 051-151-260) within the unincorporated area of San Mateo County near the City of San Carlos (City); and

WHEREAS, said properties are not within Scenic and are not currently eligible for annexation to Scenic; and

WHEREAS, said properties are not currently eligible for annexation to the City; and

WHEREAS, a determination has been made by the County Department of Health that public sewer service is necessary due to the failing septic system serving said properties as it presents a public health hazard; and

WHEREAS, Paragraph c of Government Code Section 56133 provides that the Local Agency Formation Commission (Commission) may authorize a district to provide service outside its jurisdictional boundaries and outside its sphere of influence to respond to an existing or impending threat to public health or safety; and

WHEREAS, the Director of Public Works has recommended that this Board make application to the Commission in order that sewer service may be provided to said parcels; and

WHEREAS, this Board has considered and concurs in the recommendation of the Director of Public Works.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

This Resolution of Application is hereby adopted and approved by this Board and the Local Agency Formation Commission of San Mateo County is hereby requested to take proceedings in the manner provided by the Section 56133 of the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000.

2)

The Director of Public Works is hereby authorized to submit any necessary forms or documents to the Local Agency Formation Commission associated with said application.
