Resolution Authorizing Execution of an Amendment to an Agreement for the Transport and Treatment of Sewage Collected in the Hassler Sewer Line – County/Scenic Heights/Emerald Lake Heights/City of San Carlos - San Carlos Area - Lands of Gronsky

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, acting as the governing Boards of the County of San Mateo (County), the Scenic Heights County Sanitation District (Scenic) and the Emerald Lake Heights Sewer Maintenance District (Emerald Heights), that

WHEREAS, Scenic owns the Hassler Sewer Line which transports sewage to the City of San Carlos (City) for further transport and treatment; and

WHEREAS, Scenic, County, Emerald Heights and the City entered into an agreement dated September 3, 1985, which enumerates the terms and conditions for the transport and treatment of said sewage and the payment therefore; and

WHEREAS, said agreement sets forth the area that is served by the Hassler Sewer Line; and

WHEREAS, the parties to said agreement wish to expand said area that is served by the Hassler Sewer Line to include two developed parcels with a joint failing septic system (1508 & 1510 Edgewood Road – APNs 051-151-270 and 051-151-260) and which are located in the unincorporated area; and

WHEREAS, said properties are not within Scenic and are not currently eligible for annexation to Scenic; and

WHEREAS, Paragraph c of Government Code Section 56133 provides that the Local Agency Formation Commission (Commission) may authorize a district to provide service outside its jurisdictional boundaries and outside its sphere of influence; and

WHEREAS, this Board has concurrently adopted a resolution of application to the Commission to allow Scenic to provide sewer service to said parcels; and

WHEREAS, there has been presented to this Board a form of amendment to said agreement that will allow for the expansion of the areas served by the Hassler Sewer Line to include said two parcels, and this Board has reviewed and considered same

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

1.

The President of this Board be and is hereby authorized to execute said agreement for and on behalf of the County, Emerald Heights and Scenic once the Commission has approved of Scenic providing sewer service to said parcels.

2.

The Clerk of this Board shall:

a)

attest to the signature of the President on said amendment; and

b)

have the agreement recorded with the County Recorder.
