RESOLUTION WAIVING THE REQUEST FOR PROPOSAL PROCESS, AUTHORIZING EXECUTION OF A MAINTENANCE AGREEMENT WITH CIMS LAB INC FOR SOFTWARE LICENSING AND MAINTENANCE, AND GRANTING SIGNATURE AUTHORITY TO THE CHIEF INFORMATION OFFICER TO EXECUTE SUBSEQUENT AMENDMENTS AND MINOR MODIFICATIONS IN AN AMOUNT NOT TO EXCEED $25,000.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance an Agreement with CIMS Lab Inc. to provide software licensing and maintenance for the term November 8, 2005 to November 7, 2010 for a total obligation of $129,900 and;

WHEREAS, this Board has been presented with a form of an agreement, said Board has examined and approved same as to both form and content and desires to enter into same;

WHEREAS, this Board has determined that it is in the best interest of the County to adopt the resolution and waive the Request for Proposal process based upon the associated cost savings for this proprietary software maintenance.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED

1) The Request for Proposal process is waived; 2) Signature authority is granted to the Chief Information Officer to execute subsequent amendments and minor modifications in an amount not to exceed $25,000; and 3) It is hereby authorized that the President of the Board of Supervisors is authorized and directed to execute said agreement as is approved by the County Counsel for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.
