RESOLUTION WAIVING THE REQUEST FOR PROPOSAL PROCESS AND AUTHORIZING EXECUTION OF AN AGREEMENT WITH APRIA HEALTHCARE TO PROVIDE HOME HEALTHCARE PRODUCTS AND RELATED SERVICES

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, Ordinance Code Section 2.92.050 authorizes the Board of

Supervisors to waive the Request for Proposals process in any situation where the Board determines that the best interest of the County could be served without the necessity of formal proposals; and

WHEREAS, the Chief Executive Officer of San Mateo Medical Center has asked the Board to waive the formal Request for Proposals requirements; and

WHEREAS, on July 1, 1999 the County of San Mateo, by Agreement No. 66000-00-P236, awarded a contract to Apria Healthcare, Inc. in the amount of $85,000 for the term July 1, 1999 through May 31, 2004 for the purpose of providing home healthcare products and related services to the San Mateo Medical Center; and

WHEREAS The contract with Apria Healthcare, Inc. expired on May 31, 2004 and the San Mateo Medical Center has a continued need for home healthcare services; and

WHEREAS, San Mateo Medical Center now wishes to enter into an Agreement with Apria Healthcare, Inc. to provide home healthcare products and related services for the period June 1, 2004 through May 31, 2006 for a total obligation of $175,000; and

WHEREAS there has been presented to this Board of Supervisors for its consideration and acceptance an Agreement, reference to which is hereby made, whereby Apria Healthcare, Inc. shall continue to provide services; and

WHEREAS, the Board has determined that the best interest of the County would be served by waiving the Request for Proposals process; and

WHEREAS, this Board has been presented with a form of the Agreement and has examined and approved it as to both form and content and desires to enter into the Agreement:

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby authorized and directed to waive the Request for Proposals process and execute said Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signatures thereto.
