RESOLUTION TO INCREASE THE LAW LIBRARY FEE PORTION DISTRIBUTED FROM THE UNIFORM CIVIL FEE COMMENCING JANUARY 1, 2006, AND JANUARY 1, 2007

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, B&P 6322.1 permits the Board of Supervisors to increase the amount distributed to the Law Library Trust Fund from the uniform civil fee up to $3 annually to defray the expenses of the law library;

WHEREAS, the Uniform Civil Fees and Standard Fee Schedule Act of 2005 (Stats. 2005, chap 75 (A.B. 145, also A.B. 1742)) authorizes the Board of Supervisors to increase the amount distributed to the law library fund without increasing the total amount of the Uniform Civil Fee during the Act’s moratorium period which ends January 1, 2008;

WHEREAS, the current fee collected and deposited into the Law Library trust Fund from the Superior Court of California, County of San Mateo is thirty-two dollars and fifty cents ($32.50);

WHEREAS, upkeep and subscription costs to maintain the San Mateo County Law Library collection and operations have escalated, hindering the Law Library’s ability to continue its mission to provide free access of legal materials to all persons and to maintain a collection commensurate with the needs of the community;

WHEREAS, the Board of Supervisors finds that a fee increase of three dollars ($3.00), effective January 1, 2006, and three dollars ($3.00), effective January 1, 2007, is necessary to defray the expenses of the San Mateo County Law Library;

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors increase, effective January 1, 2006, the amount distributed to the Law Library from the uniform civil fees by the Superior Courts and deposited into the Law Library Trust Fund from thirty-two dollars and fifty-cents ($32.50), to thirty-five dollars and fifty cents ($35.50);

NOW, THEREFORE, IT IS FURTHER DETERMINED AND ORDERED that the Board of Supervisors increase, effective January 1, 2007, the amount distributed to the Law Library from the uniform civil fees by the Superior Courts and deposited into the Law Library Trust Fund from thirty-five dollars and fifty cents ($35.50), to thirty-eight dollars and fifty cents ($38.50).
