RECOMMENDATION:

Adopt a Resolution authorizing a Second Amendment to the Agreement with G. E. Chen Construction, Inc., for the Noise Insulation Project within the Fourth Quarter 1999 State 65 dB CNEL Noise Contour, to extend the term by sixty days

BACKGROUND:

In 1992, the San Francisco Airport Commission entered into a Memorandum of Understanding with a number of communities, including San Mateo County, to provide funding for insulating homes within the Fourth Quarter 1999 State 65 dB CNEL noise contour. Since that time, the County has insulated 41 houses and 4 churches in the unincorporated Country Club Park area, near San Francisco International Airport. On June 27, 2000, the Board approved an agreement whereby the San Francisco Airport Commission authorized advance funding to San Mateo County to pay the cost of noise insulation up to a maximum of $50,000 for each noise easement obtained from the owners of additional eligible properties. Since then, advance funding has been authorized to pay for the cost of five additional houses owned by four property owners, in the Country Club Park area, to be insulated as part of the Commission’s ongoing efforts to reduce incompatible land uses.

 

On March 11, 2003 the County awarded an Agreement to G. E. Chen Construction to serve as the construction contractor to install the required acoustic improvements in the eligible five houses. Implementation of the project was postponed due to a delay in the County receiving the full amount of authorized funds from the Airport Commission. This resulted in the contract being amended on March 14, 2005 to increase the amount by $11,812 to cover the increase in the cost of building materials since the award of the contract.

 

DISCUSSION:

This proposed Second Amendment to extend the term of the Agreement by 60 consecutive calendar days is necessary due to a delay in the project caused by incorrect fabrication of the windows to be installed in the houses. The windows fabricated and delivered to the contractor did not meet the required acoustic rating as prescribed by the acoustical consultant. Those windows were returned to the manufacturer and a new set of windows must now be fabricated. Therefore, this unforeseen delay does not allow the contractor to complete the installation of the acoustic components of the project within the current contract time frame of 240 consecutive calendar days after the issuance of the Notice to Proceed.

 

County Counsel has reviewed and approved the Resolution and Amendment as to form.

 

FISCAL IMPACT:

The proposed Amendment extends the term of the Agreement from 240 to 300 consecutive calendar days after the issuance of the Notice to Proceed, until February 8, 2006. There is no Net County Cost associated with this Amendment.
