RESOLUTION AUTHORIZING THE EXECUTION OF A SECOND AMENDMENT TO THE AGREEMENT WITH G. E. CHEN CONSTRUCTION, INC. FOR THE NOISE INSULATION PROJECT IN THE FOURTH QUARTER 1999 STATE

65 dB CNEL NOISE CONTOUR

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on March 11, 2003, the Board of Supervisors, by Resolution Number 65869, authorized an Agreement in the amount of $93,090 for the term of completion of work of two hundred and forty consecutive calendar days after the issuance of the Notice to Proceed to sound insulate five participating houses for the County of San Mateo Noise Insulation Project within the Fourth Quarter 1999 State 65 dB noise contour; and

 

WHEREAS, on March 29, 2005, the Board of Supervisors, by Resolution 67219, authorized a First Amendment to increase the Agreement amount by $11,812, changing the Agreement obligation from $93,090 to $104,902, based on a 12.6884% increase in the Building Cost Index to allow for the increase in the cost of building materials which occurred since the Agreement was originally approved, and increase by the same amount the corporate surety bond filed by Contractor; and

 

WHEREAS, the parties wish to further amend the Agreement by extending the term from 240 to 300 consecutive calendar days after the issuance of the Notice to Proceed for the purpose of completing the noise insulation of the five eligible houses, with no additional increase in the Agreement amount; and

 

WHEREAS, the Board has been presented with this Second Amendment and desires to enter into same.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of the Board of Supervisors is hereby authorized and directed to execute said Second Amendment to the Agreement for and on behalf of the County of San Mateo; and the Clerk of this said Board shall attest the President’s signature thereto.
