SUBJECT:

First Amendment to the Agreement with Ombudsman Services of San Mateo County, Inc.

 

RECOMMENDATION:

Adopt a Resolution authorizing the President of the Board of Supervisors to execute the First Amendment to the Agreement with Ombudsman Services of San Mateo County, Inc. (OSSMC), increasing the total amount by $75,000 to $293,581 for the term July 1, 2005 through June 30, 2006.

Aging and Adult Services (AAS) strives to provide services, including contracted services, to severely impaired individuals to help them remain in the most independent setting possible. The provision of these services to this targeted population is a division-wide performance measure.

 

Performance Measure(s):

Aging and Adult Services will be developing and implementing a quality assurance measure for services provided by OSSMC over the next six months.

 

BACKGROUND:

On November 8, 2004, the Commission on Aging approved issuance of a Request for Proposals (RFP) for provision of services to older adults and adults with disabilities. AAS issued the competitive RFP during the third quarter of 2004-05 for a four-year cycle effective July 1, 2005 through June 30, 2009. Services through the RFP are funded through a combination of federal, state and county dollars, along with contributions from providers, the individuals served, the community, and other grants. Federal and state funding is provided through agreements with the California Department of Aging (CDA) for Title III/VII and Title V of the Older Americans Act (OAA), Community-Based Services Program (CBSP) and the Nutrition Services Incentive Program (NSIP) funds.

 

On July 26, 2005, your Board adopted Resolution 67461 approving an agreement with Ombudsman Services of San Mateo County, Inc., in the amount of $218,581 for a term of July 1, 2005 through June 30, 2006 for ombudsman services. This agreement is in accordance with the California Department of Aging and/or state licensing regulations and the standards and requirements established by AAS.

 

Ombudsman Services of San Mateo County is mandated by State to investigate allegations of abuse/neglect occurring in residential care facilities (i.e., skilled nursing facilities, intermediate care facilities, adult day health centers, adult day programs, residential care facilities for the elderly and adult residential facilities). Historically, funding for ombudsman services has been provided through OAA funds, which are designated for the investigation of abuse/neglect of those individuals over the age of 60, leaving the investigation of those under the age of 60 as an unfunded mandate. When OSSMC made AAS aware of this situation, AAS agreed to take over the responsibility of investigations and monitoring for those under the age of 60 in residential care settings on an interim basis. AAS has been responsible for these services for the past year and a half.

 

DISCUSSION:

In support of serving those under 60 in residential care settings, the Board of Supervisors recommended additional funds. This first amendment to the agreement includes an additional $75,000 in County General Funds: $50,000 is designated for investigating abuse and/or neglect of those under 60 who reside in residential care facilities and $25,000 is designated for general program support and service enhancement.

 

County Counsel has reviewed and approved the Resolution and Amendment as to form.

 

FISCAL IMPACT:

The term of the Agreement remains July 1, 2005 through June 30, 2006. The total obligation includes $195,619 in OAA funds and $97,962 in County General Funds. The amendment increases the funding from $218,581 by $75,000 in County General Funds, bringing the total obligation to $293,581 for FY 2005-06. Funding is included in the FY 2005-06 Aging and Adult Services Adopted Budget. The Net County Cost is $97,962.
