AN ORDINANCE AMENDING SECTION 5.124.020 AND SECTION 5.124.030 OF CHAPTER 5.124 OF TITLE 5 OF THE SAN MATEO COUNTY ORDINANCE CODE INCREASING ANNUAL DEVICE REGISTRATION FEES FOR COMMERCIAL WEIGHING AND MEASURING DEVICES

 
 

The Board of Supervisors of the County of San Mateo, State of California, ORDAINS as follows:

 

SECTION 1. Section 5.124.020 of the San Mateo County Ordinance Code is hereby amended to read as follows:

 

SECTION 5.124.020. ANNUAL DEVICE REGISTRATION PERMIT

 

(a)

No person shall temporarily or permanently, alone or in conjunction with others, establish, maintain, conduct or operate any device without first obtaining from the San Mateo County Sealer of Weights and Measures an Annual Device Registration Permit.

   

(b)

Applications for Device Registration Permits and renewals thereof shall be filed with the San Mateo County Sealer of Weights and Measures upon such forms as may be prescribed.

   

(c)

The permits shall be effective for up to one calendar year and shall expire on December 31st of each year. Such permits may be renewed without addition of a late charge if application renewal is made within 60 days of the date of first billing notice.

 

SECTION 2. Section 5.124.030 of the San Mateo County Ordinance Code is hereby amended to read as follows:

 

SECTION 5.124.030. FEES

 

(a)

The permit fee for the calendar year or any part thereof during which the permitted activity is carried on and for renewal thereof shall be as set forth below. In no case will the fee be more than the maximum charge as set forth in Section 12240 of the Business and Professions Code.

   
 

For purposes of this section, the permit fee for a business that uses a commercial weighing or measuring device or devices shall consist of a business location fee, and a device fee.

   
 

A single business location is defined as (1) each vehicle containing one or more commercial devices, (2) each business location that uses different categories or types of commercial devices that require the use of specialized testing equipment and that necessitates not more than one inspection trip by a weights and measures official.

   
 

The number of devices shall be determined as of the beginning of the fiscal year, or the commencement of business operations, whichever is earlier.

   

(b)

The business location fee shall be fifty dollars ($50) per location beginning January 1, 2006, and sixty-five dollars ($65) per location beginning January 1, 2007.

   

(c)

For marinas, mobile home parks, recreational vehicle parks, and apartment complexes, where the owner of the marina, park or complex owns and is responsible for the utility meters, the location fee shall be sixty dollars ($60) and the device fee shall be two dollars ($2) per device per space or apartment beginning January 1, 2006, and seventy dollars ($70) per location and two dollars ($2) per device per space or apartment beginning January 1, 2007. Marinas, mobile home parks, recreational vehicle parks, and apartment complexes for which the above fees are assessed shall be inspected and tested as frequently as required by regulation.

   

(d)

For weighing devices, other than livestock scales, with capacities of at least 2,000 but less than 10,000 pounds, the device fee shall be seventy dollars ($70) per device beginning January 1, 2006, and one hundred dollars ($100) per device beginning January 1, 2007. For weighing devices, other than livestock scales, with capacities of 10,000 pounds or greater, the device fee shall be one hundred and twenty dollars ($120) per device beginning January 1, 2006, and one hundred and sixty dollars ($160) per device beginning January 1, 2007.

   

(e)

For livestock scales, with capacities of at least 2,000 but less than 10,000 pounds, the device fee shall be fifty dollars ($50) per device beginning January 1, 2006, and sixty-five dollars ($65) per device beginning January 1, 2007. For livestock scales, with capacities of 10,000 pounds or greater, the device fee shall be seventy dollars ($70) per device beginning January 1, 2006, and one hundred dollars ($100) per device beginning January 1, 2007.

   

(f)

For stationary and truck mounted liquefied petroleum gas (LPG) meters, the device fee shall be eighty-five dollars ($85) per device beginning January 1, 2006, and one hundred and ten dollars ($110) beginning January 1, 2007.

   

(g)

For wholesale and vehicle meters, the device fee shall be twelve dollars ($12) per device beginning January 1, 2006, and sixteen dollars ($16) beginning January 1, 2007.

   

(h)

For all other commercial weighing or measuring devices not listed in subsections (c) to (g), inclusive, the device fee shall be ten dollars ($10) per device beginning January 1, 2006, and thirteen dollars ($13) per device beginning January 1, 2007.

   

(i)

A scale or device used in a certified farmers’ market, as defined by Section 113745 of the Health and Safety Code, is not required to be registered in the county where the market is conducted, if the scale or device has an unexpired seal for the current year, issued by a licensed California county sealer.

   

(j)

A late charge in the amount of 100% of the prescribed registration fee shall be added to the fee if application for renewal of the required permit is made after 60 days of the date of the first billing notice.

   

SECTION 3. This ordinance shall become effective thirty days from the date of adoption.
