Resolution Increasing the Not-to-Exceed Amount of the Contract for the Construction of a New Magic Mountain Playground at the Coyote Point Recreation Area – City of San Mateo (Project No. P9K01)

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board of Supervisors did, on August 9, 2005, adopt Resolution No. 67496, which awarded and authorized execution of a contract with Jensen Corporation – Landscape Contractor (the Contractor), for the Construction of the New Magic Mountain Playground at the Coyote Point Recreation Area, and

WHEREAS, the County did enter into an agreement (Agreement) with the Contractor, as authorized by said resolution; and

WHEREAS, the Agreement provides that aggregate payments to the Contractor, shall not exceed $642,000 without the Board’s approval; and

WHEREAS, the Director of Public Works has recommended that the not-to-exceed figure as originally approved by this Board be increased to include all Additive Bid Alternates that were provided at the time the original bids for the work were opened; and

WHEREAS, this Board has considered and concurs in the recommendation of the Director of Public Works.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

The Agreement with the Contractor, entered on August 9, 2005, for the Construction of the New Magic Mountain Playground at the Coyote Point Recreation Area, San Mateo, is hereby amended to provide that aggregate payments to the Contractor, for said work shall not exceed the sum of One Million Sixty-Three Thousand Eight Hundred Eighty-Eighty and No/100 Dollars ($1,063,888.00) without this Board’s approval.

2.

That, with the exception of modification as herein provided, the aforementioned Agreement with the Contractor shall remain unchanged.
