BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION AUTHORIZING THE CHIEF ELECTIONS OFFICER TO EXECUTE FUNDING AGREEMENTS WITH THE CALIFORNIA SECRETARY OF STATE UNDER THE “HELP AMERICA VOTE ACT OF 2002” (HAVA) FOR ELIGIBLE EXPENDITURES TO IMPROVE THE ADMINISTRATION OF ELECTIONS

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the Help America Vote Act of 2002 (42 U.S.C. 15301 et seq.) (“HAVA”) established national standards for the administration of elections, created the Elections Assistance Commission, and appropriated funds for requirements payments to be implemented by state administrators for the purpose of reimbursing state and local governments for eligible expenditures made to achieve compliance with HAVA; and

 

WHEREAS, the California Secretary of State, as the HAVA funding administrator, requires an authorizing resolution of this Board for this County to participate in HAVA funding programs, and recommends broad delegation of authority to the Chief Elections Officer to execute any HAVA funding agreement or related amendment for which the County may qualify; and

 

WHEREAS, San Mateo County is currently eligible to enter into funding agreements under HAVA Section 261 (up to $78,406.82 through June 30, 2007 to ensure access for disabled voters), Section 303 ($17,500 through June 1, 2006 to develop and implement a statewide, integrated voter registration database), neither of which require County matching funds; and

 

WHEREAS, there has been presented to this Board for its consideration and approval a form of agreement to participate in the Section 261 program, and a request to authorize San Mateo County’s Chief Elections Officer to execute said agreements and other HAVA funding agreements and related amendments; and

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Chief Elections Officer is hereby authorized to execute said agreements and all other HAVA funding agreements and related amendments for and on behalf of the County of San Mateo.
