Amendment to the Agreement with Quest Diagnostics

 

RECOMMENDATION:

Adopt a resolution:

A)

Waiving the Request for Proposal requirement; and

   

B)

Authorizing the President of the Board to approve an amendment to the Agreement with Quest Diagnostics for the term July 1, 2002, through December 31, 2005, for a maximum obligation of $702,000, Net County Cost of $71,500.

BACKGROUND:

On January 28, 2003, your Board approved an agreement with Quest Diagnostics to provide laboratory services for Mental Health Services for the term July 1, 2002, through June 30, 2005, and for Correctional Health Services for the term July 1, 2002, through June 30, 2003. On December 16, 2003, your Board approved an amendment to that agreement to extend the term of services for Correctional Health through June 30, 2005.

 

In May of 2005, the Health Department released a Request for Proposals for laboratory services for Mental Health Services and Correctional Health. Proposals were received from Laboratory Corporation of America (LabCorp) and Quest. LabCorp was selected to provide these services.

 

DISCUSSION:

The agreement with Quest is being amended to extend the term through December 31, 2005 in order to maintain the provision of services until such time as the agreement with LabCorp is in place. A waiver of the Request for Proposals requirement is requested in order to extend the term of this amended agreement beyond three years.

 

The overall usage of services for Mental Health Services over the three-year term was slightly greater than anticipated. As a result, $12,000 in additional funds is being added to the agreement for FY 2004-05.

 

The amended agreement has been approved by County Counsel and Risk Management. The agreement was on the continuing resolution through December 31, 2005. The amendment is late due to the prioritization of Mental Health Services Act planning efforts in Mental Health, unplanned staff shortages, and delay by the contractor in returning the agreement.

 

FISCAL IMPACT:

The agreement maximum is being increased by $147,000 for the agreement term, to a new maximum of $702,000. The increase includes additional funding for Mental Health Services in the amount of $12,000 for FY 2004-05.

 

The maximum increase for FY 2005-06 is $135,000, including $75,000 for Mental Health and $60,000 for Correctional Health. For Mental Health 85% or $63,750 will come from State and federal Medi-Cal, and $11,250 is the Net County Cost. Funding for Correctional Health is 100% Net County Cost. The total Net County Cost for FY 2005-06 is $71,250.
