RESOLUTION WAIVING THE REQUEST FOR PROPOSAL REQUIREMENT AND AUTHORIZING EXECUTION OF AN AMENDMENT TO THE AGREEMENT WITH QUEST DIAGNOSTICS FOR THE TERM JULY 1, 2002 THROUGH DECEMBER 31, 2005, FOR A MAXIMUM OBLIGATION OF $702,000

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board approved an Agreement with Quest Diagnostics for clinical laboratory services on January 28, 2003, for Mental Health Services for the term July 1, 2002, through June 30, 2005, and Correctional Health Services for the term July 1, 2002, through June 30, 2003, for a maximum obligation of $475,000; and

WHEREAS, this Board approved an amendment to that Agreement on December 16, 2003, to extend the term for Correctional Health Services through June 30, 2005, and increasing the maximum obligation to $555,000, and;

WHEREAS, both parties wish to amend the agreement to extend the term of the agreement through December 31, 2005, and increase the maximum obligation by $147,000 to a new maximum of $702,000 in order to maintain services while an agreement with a new provider is being negotiated; and

WHEREAS, Ordinance Code Section 2.92.160 authorizes the Board of Supervisors to waive the Request for Proposals process in any situation where the Board of Supervisors determines that the best interest of the county could be served without the necessity of proposals; and

WHEREAS, this Board has been presented with a form of the amendment to the Agreement and has examined and approved it as to both form and content and desires to enter into the amendment to the Agreement:

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Request for Proposal requirement is hereby waived; and

BE IT FURTHER RESOLVED, that the President of this Board of Supervisors is authorized to execute said amendment to the Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.
