BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION AUTHORIZING (1) ACCEPTING A THIRTY SIX MONTH GRANT (2) WAIVING THE REQUEST FOR PROPOSAL (RFP) PROCESS; (3) THE EXECUTION OF AN AGREEMENT WITH EL CENTRO DE LIBERTAD FOR THE SERVICES FUNDED BY THE GRANT; AND (4) AUTHORIZING THE DIRECTOR OF THE HUMAN SERVICES AGENCY TO EXECUTE AMENDMENTS AND CHANGES; HOWEVER, AS TO EACH AMENDMENT, SUCH AUTHORITY IS LIMITED TO:

A)

AMENDMENTS AND MINOR MODIFICATIONS NOT TO EXCEED AN AGGREGATE OF $25,000 PER FUNDING SOURCE, AND

B)

CHANGES IN THE TYPES OF SERVICES AND ACTIVITIES PROVIDED BY THE CONTRACTOR, PROVIDED THAT THE CHANGES HAVE NO IMPACT ON THE COUNTY’S MAXIMUM FISCAL OBLIGATION.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, there has been presented to this Board of Supervisors a request to 1) Accept a thirty six month grant from the Department of Health and Human Services (DHHS) Center fro Substance Abuse Treatment (CSAT) Grant Number 1 H79 TI 17317-01; 2) Waive the Request for Proposal process with respect to contracting for services funded by the grant; 3) Execute an Agreement with El Centro de Libertad for the services funded by the grant; and 4) Authorize the Director of the Human Services Agency to execute certain amendments to the Agreement with El Centro de Libertad as set forth below; and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance the Agreement with the El Centro de Libertad, for the provision of the Methamphetamine and other stimulant drug treatment services as required by the Grant and it is in the best interests of the County to waive the request for proposal process with respect to said Agreement because El Centro de Libertad was the Contractor designated to provide services pursuant to the grant; and

WHEREAS, the term of this Agreement is August 15, 2005 through February 14, 2009 with a total obligation of $700,000; and

WHEREAS, this Board has been presented with a form of this Agreement and has examined and approved such Agreement as to both form and content and desires to enter into this Agreement.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the:

President of this Board of Supervisors be and is hereby authorized and directed to:

1) Accept a thirty six month grant from the Department of Health and Human Services (DHHS) Center for Substance Abuse Treatment (CSAT) Grant Number 1 H79 TI 17317-01; and

2) Waive the Request for Proposal process; and

3) Execute said Agreement for and on behalf of the County of San Mateo; and

4) Authorize the Director of the Human Services Agency to execute subsequent amendments and minor modifications thereto during the initial term of this Agreement; however, as to each Amendment, such authority is limited to:

a) Amendments and minor modifications not to exceed an aggregate of $25,000 per funding source, and

b) Changes in the types of services and activities provided by the Contractor, provided that the changes have no impact on the County’s maximum fiscal obligation, and the Clerk of this Board shall attest the President’s signature thereto.
