BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION AUTHORIZING (1) THE ACCEPTANCE OF A THIRTY SIX MONTH GRANT; AND (2) THE WAIVER OF THE REQUEST FOR PROPOSAL (RFP) PROCESS AND THE EXECUTION OF AGREEMENTS WITH ASIAN AMERICAN RECOVERY SERVICES AND WESTED FOR THE SERVICES FUNDED BY THE GRANT; AND (3) THE DIRECTOR OF THE HUMAN SERVICES AGENCY (A) TO EXECUTE ALL NECESSARY DOCUMENTS IN CONNECTION WITH ANY MODIFICATIONS MADE BY THE STATE REGARDING THE GRANT AND (B) ANY SUBSEQUENT AMENDMENTS AND CHANGES TO THE AGREEMENTS; HOWEVER, AS TO EACH AMENDMENT, SUCH AUTHORITY IS LIMITED TO:

1)

AMENDMENTS AND MINOR MODIFICIATIONS NOT TO EXCEED AN AGGREGATE AMOUNT OF $25,000; AND

2)

CHANGES IN THE TYPES OF SERVICES AND ACTIVITIES PROVIDED BY THE CONTRACTOR, PROVIDED THAT THE CHANGES HAVE NO IMPACT ON THE COUNTY’S MAXIMUM FISCAL OBLIGATIONS UNDER THE AGREEMENTS.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, there has been presented to this Board of Supervisors a request to 1) Accept a thirty six month grant from the Department of Health and Human Services Center for Substance Abuse Treatment (“DHHS/CSAT”) Grant Number 1 H79 TI 17308-01; 2) Waive the Request for Proposal process with respect to contracting for services funded by the grant; 3) Execute Agreements with Asian American Recovery Services (“AARS”) and WestEd for the services funded by the grant; and 4) Authorize the Director of the Human Services Agency to execute and all necessary documents in connection with any modifications made by the state with respect to the grant and certain amendments to the Agreements as set forth below; and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance the Agreements with AARS and WestEd, for the provision of the Brief Strategic Family Therapy and other treatment services as required by the Grant and it is in the best interests of the County to waive the Request For Proposal process with respect to said Agreements because AARS and WestEd were the Contractors designated to provide services pursuant to the grant; and

WHEREAS, the term of the Agreement with AARS is September 30, 2005 through September 29, 2008 with a total obligation of $1,215,779; and the term of the Agreement with WestEd is September 30, 2005 through September 29, 2008 with a total obligation of $150,000; and

WHEREAS, this Board has been presented with a form of the grant and each of the Agreements and has examined and approved such Agreements as to both form and content and desires to enter into the Agreements.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED THAT THE:

President of this Board of Supervisors be and is hereby authorized and directed to:

1) Accept the thirty six month grant from the Department of Health and Human Services DHHS/CSAT Grant Number 1 H79 TI 17308-01; and

2) Waive the Request for Proposal process for services funded by the grant; and

3) Execute said Agreements with AARS and WestEd for and on behalf of the County of San Mateo, and the Clerk of this Board shall attests the President’s signature thereto; and

4) Authorize the Director of the Human Services Agency to execute (a) all necessary documents in connection with any modifications made by the State with respect to the Grant and (b) all subsequent amendments and minor modifications to the Agreements during the initial term on these Agreements; however, as to each Amendment, such authority is limited to:

a) Amendments and minor modifications not to exceed an aggregate amount of $25,000 per Agreement; and

b) Changes in the types of services and activities provided by the Contractor, provided that the changes have no impact on the County’s maximum fiscal obligation.
