BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION AUTHORIZING (1) THE ACCEPTANCE OF TWO TWENTY FOUR (24) MONTH GRANT EXTENSIONS FROM THE STATE OF CALIFORNIA DEPARTMENT OF ALCOHOL AND DRUG PROGRAM FOR SAFE AND DRUG-FREE SCHOOLS AND COMMUNITIES; AND (2) THE WAIVER OF THE REQUEST FOR PROPOSAL (RFP) PROCESS AND THE EXECUTION OF AGREEMENTS WITH ASIAN AMERICAN RECOVERY SERVICES, INC., AND YOUTH LEADERSHIP INSTITUTE FOR THE SERVICES FUNDED BY THE GRANTS; AND (3) THE DIRECTOR OF THE HUMAN SERVICES AGENCY TO EXECUTE ALL NECESSARY DOCUMENTS IN CONNECTION WITH ANY MODIFICATIONS MADE BY THE STATE REGARDING THE GRANTS AND SUBSEQUENT AMENDMENTS AND CHANGES TO THE AGREEMENTS; HOWEVER, AS TO EACH AMENDMENT, SUCH AUTHORITY IS LIMITED TO:

    1)

AMENDMENTS AND MINOR MODIFICATIONS NOT TO EXCEED AN AGGREGATE AMOUNT OF $25,000 PER AGREEMENT, AND

2)

CHANGES IN THE TYPES OF SERVICES AND ACTIVITIES PROVIDED BY THE CONTRACTORS, PROVIDED THAT THE CHANGES HAVE NO IMPACT ON THE COUNTY’S MAXIMUM FISCAL OBLIGATION.

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, there has been presented to this Board of Supervisors a request to 1) accept two twenty four (24) month grant extensions from the State of California Department of Alcohol and Drug Programs for Grant Number SDF03-05 in the additional amount of $300,000, and Grant Number SDF03-12 in the additional amount of $298,130; 2) waive the Request for Proposal process with respect to the services funded by the grants; 3) authorize the President of the Board to execute Agreements with Asian American Recovery Services, Inc., and Youth Leadership Institute for the services funded by the grants; and 4) authorize the Director of the Human Services Agency to execute all necessary documents in connection with any modifications of the grants and certain amendments to the Agreements as set forth below; and

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance the Agreements with Asian American Recovery Services, Inc., and Youth Leadership Institute, for the provision of alcohol and drug services as required by the grants and it is in the best interests of the County to waive the Request For Proposal (RFP) process with respect to said Agreements because Asian American Recovery Services, Inc., and Youth Leadership Institute were the Contractors designated to provide services pursuant to the grants; and

 

WHEREAS, the term of these Agreements is January 1, 2006 through December 31, 2007 with a total obligation of $162,000 for Asian American Recovery Services, Inc., and $123,000 for Youth Leadership Institute; and

 

WHEREAS, this Board has been presented with a form of these grants and Agreements and it is in the best interested of the County to accept the grants, and the Board has examined and approved such Agreements as to both form and content and desires to enter into these Agreements.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED THAT THE:

 

President of this Board of Supervisors be and is hereby authorized and directed to:

1) Accept two twenty four (24) month grant extensions from the State of California Department of Alcohol and Drug Programs for continuation of services provided through the Safe and Drug-Free Schools and Community Grants Number SDF03-05 and SDF03-12; and

2) Waive the Request for Proposal process for services funded by the grants; and

    3) Execute said Agreements with AARS and YLI for and on behalf of the County of San Mateo and the Clerk of this Board shall attest the President’s signature thereto; and

    4) The Director of the Human Services Agency is hereby authorized to execute (a) all necessary documents in connection with any modifications made by the state with respect to the grants and (b) all subsequent amendments and minor modifications to the Agreements during the initial term of these Agreements; however, as to each Amendment, such authority is limited to:

1) Amendments and minor modifications not to exceed an aggregate amount of $25,000 per Agreement, and

2) Changes in the types of services and activities provided by the Contractor, provided that the changes have no impact on the County’s maximum fiscal obligation.
