Resolution Authorizing Execution of the First Amended and Restated Joint Exercise of Powers Agreement for the South Bayside Waste Management Authority

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the County of San Mateo is a member of the South Bayside Waste Management Authority (“SBWMA”), a joint powers authority whose other members are the cities of Burlingame, Hillsborough, San Mateo, Foster City, Belmont, San Carlos, Redwood City, Atherton, East Palo Alto and Menlo Park, and the West Bay Sanitary District; and

WHEREAS, the SBWMA intends to recruit and hire its first executive director in the near future and an amendment of the SBWMA joint powers agreement entered into on December 9, 1999 and amended on June 4, 2002 is needed to create said position and define its duties; and

WHEREAS, the SBWMA has prepared a proposed First Amended and Restated Joint Exercise of Powers Agreement for the SBWMA, which creates and defines the duties of an executive director, defines powers of the SBWMA that require member agency approval, clarifies the member agency staff positions from which a member agency may designate its director on the SBWMA Board of Directors, redefines the Chair of the SBWMA as being selected annually from among the Board of Directors and makes other non-substantive changes to the current joint powers agreement as amended of the SBWMA; and

WHEREAS, said proposed First Amended and Restated Joint Exercise of Powers Agreement has been presented to this Board for review; and

WHEREAS, this Board of Supervisors has considered said proposed First Amended and Restated Joint Exercise of Powers Agreement and desires to execute the same.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

1.

This Board of Supervisors approves said First Amended and Restated Joint Exercise of Powers Agreement for the South Bayside Waste Management Authority.

2.

The President of this Board of Supervisors be, and is hereby, authorized and directed to execute said First Amended and Restated Joint Exercise of Powers Agreement for the for and on behalf of the County of San Mateo.

3.

The signature of the Clerk of this Board shall attest to the President’s signature thereto as or if required.
