Amendment to Agreement with G. E. Chen Construction for the Noise Insulation Project within the Fourth Quarter 1999 State 65 dB CNEL Noise Contour

 
 

RECOMMENDATION:

Adopt Resolutions:

 

A) Authorizing an Amendment to the Agreement with G. E. Chen Construction for the Noise Insulation Project within the Fourth Quarter 1999 State 65 dB CNEL Noise Contour

 

B) Authorizing an Appropriation Transfer Request in the amount of $196,074 from Unanticipated Revenue to Services and Supplies to cover the costs of the Amendment

BACKGROUND:

On June 27, 2000 the County of San Mateo executed an Agreement with the City and County of San Francisco, by and through the San Francisco Airport Commission, to provide the County of San Mateo with advance funding to insulate eligible houses within the unincorporated County Club Park area against noise impacts from aircraft operations at San Francisco International Airport. On March 11, 2003 the County awarded an Agreement to G. E. Chen Construction to install the required acoustic improvements, and that work is complete.

The Federal Aviation Administration (FAA) more recently determined that a private school in the Country Club Park neighborhood is also eligible for federal noise insulation funding. On July 27, 2004 San Mateo County accepted a combined Grant Offer from the FAA that provided 80% reimbursement for the houses and the school. The San Francisco Airport Commission will provide the remaining 20%.

 

DISCUSSION:

On December 13, 2005 the San Mateo County Board of Supervisors approved an Amendment to the original Agreement with the San Francisco Airport Commission to include $2,437,650 for the private school insulation improvements bringing the total maximum amount of advance funding from the Airport Commission to $2,689,250 ($251,600 for the houses that are now complete and $2,437,650 for the private school).

The proposed Amendment to the contract with G. E. Chen Construction is needed to: 1) include the private school in the scope of work; 2) extend the term of the contract to September 30, 2006; and 3) increase the amount of the contract by $196,074 from $104,902 (for the houses that are now complete) to $300,976 so that G. E. Chen Construction can install the acoustical improvements in the private school.

 

The proposed ATR would provide appropriation in the amount of $196,074 to fund this Amendment from unanticipated revenue.

 

County Counsel has reviewed and approved the Resolution and Amendment as to form.

 

FISCAL IMPACT:

The total cost of the proposed Amendment is $196,074. This amount will be fully reimbursed by the City and County of San Francisco through the San Francisco Airport Commission (20%) and the Federal Aviation Administration (80% via a federal grant). There will be no direct costs to the County as a result of this Amendment.
