SUBJECT:

Consideration of a Regulatory Agreement between the County and James Spilker, Jr., and Anna Marie Spilker for an affordable housing unit located at 19509 Cabrillo Highway in the unincorporated San Gregorio area of San Mateo County.

 

RECOMMENDATION

 

Adopt a resolution authorizing:

 

A.

A Regulatory Agreement and Declaration of Restrictive Covenants between James Spilker, Jr., and Anna Marie Spilker and the County to ensure the long-term affordability of a housing unit.

   

B.

The County Manager or his designee to record the agreement.

   

VISION ALIGNMENT

 

Commitment: Number 4 (Offer a Full Range of Housing Choices): The replacement of a previous farm labor housing unit with an affordable housing unit, which this contract agreement will formally implement, fulfills this commitment.

 

Goal: Number 9, which states: “Housing exists for people at all income levels and for all generations of families.” The project contributes to this commitment and goal by providing for housing available to residents who might otherwise not be able to afford housing due to income limitations.

 

BACKGROUND

 

The applicant is proposing to replace a farm labor housing unit with an 1,800 sq. ft. affordable housing unit. On January 19, 2006, the Zoning Hearing Officer (ZHO) approved the replacement from farm labor housing with affordable housing at 19509 Cabrillo Highway in San Gregorio. The subject 125-acre parcel is zoned Planned Agricultural District and is developed with a single-family residence, one existing unoccupied farm labor housing modular home, a barn, water tanks for fire purposes and a tree farm.

 

SUMMARY

 

To implement the ZHO’s decision, the Board of Supervisors will need to consider and adopt a resolution approving a Regulatory Agreement to restrict the property permanently to affordable housing. Attached for the Board’s consideration are the proposed resolution and an agreement. The Agreement sets forth the terms and conditions for maintaining the property as affordable housing. If approved, the Agreement will be recorded on the applicant’s property and periodically monitored by the Planning Division.

 

The LCP provides 30 floating density credits total, which can be used to provide affordable housing in the rural south coast and 10 in the rural Midcoast. Staff has determined there are 20 authorized affordable housing units to date in the south coast, which includes the proposed project. Five units have been authorized in the rural Midcoast, for a total of 25 altogether.

 

FISCAL IMPACT

 

Nominal cost to Planning Division to monitor compliance periodically.
