Amendment One to the Service Agreement with the City of Millbrae.

 

RECOMMENDATION:

Adopt a Resolution authorizing the execution of Amendment One to the Service Agreement with the City of Millbrae for provision of limited law enforcement services provided by the Sheriff’s Office, increasing the contract reimbursement maximum by $95,001, from $99,999 to $195,000, as well as extending the term from October 31, 2005 to June 30, 2006.

BACKGROUND:

The Sheriff’s Office has been providing supplemental law enforcement services to the City of Millbrae for the past eight months. This enables the Millbrae Police Department to maintain patrol shifts while they recruited for vacant positions.

The Agreement provides for up to three Sheriff’s Deputies to provide law enforcement services on a shift basis, each position working regularly scheduled twelve-hour shifts. The number of Deputies needed, the shifts to be filled, and the scheduling of those shifts are determined by the City in collaboration with the Sheriff’s Office. The number of Sheriff’s Deputies working within the City at any one time ranges from two or three, to none. Additionally, the Sheriff’s Office presently provides part-time detective services, which at the time the Agreement was executed were estimated to be 20 hours per week.

 

DISCUSSION:

Usage of the Agreement was highest in the first several months, while the City was filling a number of vacant positions, and the original Agreement reached the contractual maximum in the late Fall of 2005. Anticipating this situation, the Sheriff’s Office and the City agreed to amend and extend the Agreement. In November 2005, the Millbrae City Council approved this Amendment One to the Agreement. Amendment One extends the term from October 31, 2005 to June 30, 2006, as well as increases the contractual maximum by $95,001 to $195,000. The processing of the First Amendment has been delayed due to transmission errors between the City and the County.

A second Amendment, which adds $35,000 to the Agreement maximum to cover reimbursable costs through the end of June 2006, has been discussed with the City, and is currently in progress. This will be brought to your Board separately in about one month.

County Counsel has review and approved the First Amendment as to form.

 

FISCAL IMPACT:

The Agreement, and Amendment No. 1, requires full reimbursement of the personnel cost of existing Sheriff’s Deputies assigned to the City for various temporary periods of time. This time is separately tracked by the Patrol Bureau, and invoicing of the City occurs monthly. Sheriff’s Deputies serve in City patrol cars, and report through Millbrae Patrol Sergeants, so no significant overhead costs are incurred in the provision of this contractual service. Thus, there is no increase in or impact on net County General Fund cost from the original Agreement, or from this Amendment.
