RESOLUTION TO AMEND
THE 2005-2006 LEGISLATIVE SESSION PROGRAM TO INCLUDE A LEGISLATIVE PROPOSAL FOR SENATE BILL 1483 (ALQUIST), CHILD SUPPORT.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that
|
|
WHEREAS, current law requires child support orders to be modified through a time-consuming court procedures, which can take up to 120 days or more; and
|
|
WHEREAS, a significant amount of time and resources, including the work of attorneys, paralegals, court staff and child support officers, is required to review and prepare for a hearing; and
|
|
WHEREAS, an estimated 20% to 40% of motions to modify child support are not contested by either the non-custodial parent or the custodial parent, but must proceed through the noticed motion procedure nonetheless; and
|
|
WHEREAS, SB 1483 would include the County of San Mateo in a pilot to provide for an expedited out-of-court procedure to modify child support orders when neither parent objects to the adjustment; and .
|
|
|
WHEREAS, this pilot is expected to ensure more timely modifications to child support orders, increase the percentage of current support collected, reduce the accrual of arrears, increase the cost-effectiveness of participating Local Child Support Agencies and improve customer service to all parties,
|
|
NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors amends the 2005-2006 Legislative Session Program to include a legislative proposal for Senate Bill 1483 (Alquist) regarding Child support.
