RESOLUTION AUTHORIZING (1) THE ACCEPTANCE OF A THIRTY SIX (36) MONTH GRANT FROM THE DEPARTMENT OF HEALTH AND HUMAN SERVICES (DHHS) CENTER FOR SUBSTANCE ABUSE AND MENTAL HEALTH SERVICES; AND (2) THE WAIVER OF THE REQUEST FOR PROPOSAL (RFP) PROCESS AND THE EXECUTION OF AN AGREEMENT WITH YOUTH AND FAMILY ENRICHMENT SERVICES FOR THE SERVICES FUNDED BY THE GRANT; AND (3) THE DIRECTOR OF THE HUMAN SERVICES AGENCY TO EXECUTE ALL NECESSARY DOCUMENTS IN CONNECTION WITH ANY MODIFICATIONS MADE BY THE STATE REGARDING THE GRANT AND SUBSEQUENT AMENDMENTS AND CHANGES TO THE AGREEMENT; HOWEVER, AS TO EACH AMENDMENT, SUCH AUTHORITY IS LIMITED TO:

1)

AMENDMENTS AND MINOR MODIFICATIONS NOT TO EXCEED AN AGGREGATE AMOUNT OF $25,000 PER AGREEMENT, AND

2)

CHANGES IN THE TYPES OF SERVICES AND ACTIVITIES PROVIDED BY THE CONTRACTOR, PROVIDED THAT THE CHANGES HAVE NO IMPACT ON THE COUNTY’S MAXIMUM FISCAL OBLIGATION.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, there has been presented to this Board of Supervisors a request to 1) accept a thirty six (36) month grant from the Department of Health and Human Services for Grant Number 1 H79 TI17446-01 in the amount of $1,166,970; 2) waive the Request for Proposal process with respect to the services funded by the grant; 3) authorize the President of the Board to execute an Agreement with Youth and Family Enrichment Services, for the services funded by the grant; and 4) authorize the Director of the Human Services Agency to execute all necessary documents in connection with any modifications of the grants and certain amendments to the Agreement as set forth below; and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance the Agreement with Youth and Family Enrichment Services, for the provision of alcohol and drug services as required by the grant and it is in the best interest of the County to waive the Request For Proposal (RFP) process with respect to said Agreement because Youth and Family Enrichment Services was the Contractor designated in the grant to provide such services; and

WHEREAS, the term of the Agreement is September 30, 2005 through September 29, 2008 with a total obligation of $450,000; and

WHEREAS, this Board has been presented with a form of the grant and the Agreement and it is in the best interests of the County to accept the grant, and the Board has examined and approved such Agreement as to both form and content and desires to enter into the Agreement.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED THAT THE:

President of this Board of Supervisors be and is hereby authorized and directed to:

1) Accept the thirty six (36) month grant from the Department of Health and Human Services for services (Substance Abuse and Mental Health Services Grants Number 1 H79 TI17446-01);

2) Waive the Request for Proposal process for services funded by the grant;

3) Execute the Agreement with Youth and Family Enrichment Services for and on behalf of the County of San Mateo to provide the services set forth in the grant and the Clerk of this Board shall attest the President’s signature thereto; and

4) The Director of the Human Services Agency is hereby authorized to execute (a) all necessary documents in connection with any modifications made by the state with respect to the grant and (b) all subsequent amendments and minor modifications to the Agreement during the initial term of this Agreement; however, as to each Amendment, such authority is limited to:

1) Amendments and minor modifications not to exceed an aggregate amount of $25,000 per Agreement; and

2) Changes in the types of services and activities provided by the Contractor, provided that the changes have no impact on the County’s maximum fiscal obligation.
