Resolution Authorizing Execution of a Cable Franchise Agreement with Comcast of California, IX, Inc., Comcast of California/Colorado/Florida/Oregon, Inc., Comcast of California/Illinois, LP and Comcast of California/Colorado/Washington, LP

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, Comcast of California, IX, Inc., Comcast of California/Colorado/Florida/Oregon, Inc., Comcast of California/Illinois, LP and Comcast of California/Colorado/Washington, LP (“Comcast”) provides cable services in San Mateo County (“County”) through an existing Cable System Franchise Agreement; and

 

WHEREAS, on March 1, 2003, the existing franchise agreement with Comcast expired and subsequently was extended; and

 

WHEREAS, the County and Comcast have negotiated in good faith for terms and conditions for a successor cable system franchise agreement (“Franchise Agreement”); and

 

WHEREAS, the County and Comcast have agreed to terms that are incorporated in a Franchise Agreement, including pertinent exhibits and a side letter that are incorporated by reference and attached hereto; and

 

WHEREAS, the Director of Public Works has recommended that the terms of a 15-year, non-exclusive cable systems Franchise Agreement be approved and adopted by this Board, and this Board has reviewed and concurs in the recommendation of the Director of Public Works.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

 
 

The President of this Board be and is hereby authorized and directed to execute:

 
 

Ø

a 15-year non-exclusive Franchise Agreement with Comcast with an expiration date of March 28, 2021;

 
 

Ø

a side letter to the Franchise Agreement which provides additional information on PEG access channels, technical grants, and future cable transfers.
