Resolution Awarding and Authorizing Execution of a Contract for the Reconstruction of Ninth Avenue – North Fair Oaks Area
(Project No. RD100, F-36 [305-1B])

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board of Supervisors did, on June 21, 2005, adopt Resolution No. 067385, which resolution approved the specifications, determined the prevailing wage scales and called for the sealed proposals for the reconstruction of Ninth Avenue; and

WHEREAS, this Board of Supervisors, on August 9, 2005, after all bids for the previously described work were submitted and opened, adopted Resolution No. 067493, which resolution relieved the low bidder of their bid due to errors, rejected all other bids received, and authorized the Director of Public Works to re-advertise the project as described in the previously adopted plans and specifications, for sealed proposals; and

WHEREAS, the Clerk of this Board of Supervisors did, in public on April 4, 2006, open and examine all sealed proposals that were received in the specified time for the doing of the work referred to in said Resolution No. 067385; and

WHEREAS, this Board of Supervisors has caused an analysis of said proposals to be made by the Director of Public Works of the County of San Mateo, and has, in open session, fully reviewed and considered said sealed proposals and the analysis thereof; and

WHEREAS, the lowest responsible bid was submitted by Interstate Grading and Paving, Inc., in the amount of Three Hundred Sixty-Six Thousand Two Hundred Forty-Two and 00/100 Dollars ($366,242.00) based on an estimate of the amount of work to be done.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

It is to the best interest of the County of San Mateo to award the contract for the reconstruction of Ninth Avenue to:

Interstate Grading and Paving, Inc.

128 South Maple Avenue

South San Francisco, CA 94080

2.

The County of San Mateo shall enter into a written agreement with Interstate Grading and Paving, Inc., for the doing of said work as required by the plans and specifications therefore adopted and approved by this Board of Supervisors, as hereinbefore mentioned, said plans and specifications being on file in the office of the Director of Public Works of the County of San Mateo.

The President of this Board of Supervisors on behalf of the County of San Mateo shall be, and is hereby, authorized and directed to execute an agreement with Interstate Grading and Paving, Inc. for the work described herein, subject to the Department of Public Works receipt and approval of the Faithful Performance Security Bond and the Payment Bond required to be posted by said Contractor in connection therewith.

All payments to the Contractor be in accordance with the plans, specifications, and other contract documents, based on the Director of Public Works’ written estimate of work actually done.

5.

Paragraph 4 above notwithstanding, aggregate payment to Contractor shall not exceed the sum of Four Hundred Two Thousand Eight Hundred Fifty Dollars ($402,850) without this Board’s prior approval.

6.

The Clerk of the Board of Supervisors, County of San Mateo, is hereby authorized and directed to attest the signature of the President of this Board of Supervisors to said written contract.
