Revisions to Chapter 7.28 (Miscellaneous Parking Regulations) of Title 7, Vehicle and Traffic, of the San Mateo County Ordinance Code - Limited Parking to Facilitate Street Sweeping

 

Recommendation

1.

Adopt an ordinance repealing Sections 7.28.170, 7.28.180, 7.28.200, 7.28.220 and 7.28.230 of the San Mateo County Ordinance Code that limits parking to facilitate street sweeping; and

 

2.

Adopt a resolution designating no parking during specified hours zones to facilitate street sweeping in the North Fair Oaks, Dumbarton Oaks and Daly City areas, including limiting parking on additional streets in the North Fair Oaks area.

Background

 

Previous Board Action

Adopted similar ordinances which streamlined the Prima Facie Speed Limits; Time Limited Parking; No Parking and No Parking During Specified Hours; and Disabled Parking Zones in the Ordinance Code.

 

History

Section 22507.6 of the California Vehicle Code (CVC) provides that local authorities may, by ordinance or resolution, prohibit or restrict parking on designated streets for the purpose of street sweeping. The ordinance or resolution does not take effect until signs indicating the days and times of the restrictions have been posted on the affected street.

 

Miscellaneous parking regulations governing street sweeping zones are currently codified in chronological order in Section 7.28 of the County Ordinance Code. Existing parking ordinances related to street sweeping date back to 1989.

 

Discussion

We are recommending that the streets, portions of streets and County owned property within the unincorporated area where parking has been limited to facilitate street sweeping, no longer be listed in the Ordinance Code and be approved by resolution. The locations of parking restrictions on County maintained streets are currently documented on GIS maps in the Department of Public Works, and will be made available in list form on the Department’s web site.

 

The proposed resolutions reauthorize the existing limited parking zones and add additional zones in the North Fair Oaks area.

 

The additional zones encompass portions of 2nd, 3rd, 4th and 5th Avenues; Barron Avenue; Crocker Avenue; Edison Way; Flood Avenue; Hurlingame Avenue; and Warrington Avenue. They were either requested by a business owner, are being created to improve sweeping along streets where minimum street improvements are being constructed or are being established to make sweeping operations consistent on the streets between Spring Street and Middlefield Road. Exhibit ‘A’ displays the locations of existing and new street sweeping zones in North Fair Oaks.

 

Postcards have been sent to the owners of property adjacent to the new street sweeping zones notifying them that this report is available on the internet, or that we will send them a copy if requested. We have also sent copies of our report to the Sheriff, the California Highway Patrol and the North Fair Oaks Council.

 

The ordinance and resolution have been approved as to form by County Counsel. We will maintain the list of approved parking regulations on the Department of Public Works web site.

 

Fiscal Impact

The cost of the staff time involved in evaluating and processing requests for parking regulations is part of the administrative costs associated with evaluating traffic-related requests involving the County maintained road system, and is financed with Road Funds. The cost of signing and marking a limited parking zone to facilitate street sweeping varies, but averages out to approximately $200 per side of a street. This cost is also financed with Road Funds.

 

Ordinance Code revisions are compiled and published by County Counsel and the cost of this work is financed with General Funds. This revision will eliminate seven (7) pages from the Ordinance Code. We believe that there will be a minimal savings to the General Fund as updates to the Ordinance Code will no longer have to be published each time a new street sweeping zone is approved or eliminated.
