Annexation of Property to the Fair Oaks Sewer Maintenance District - Lands of Upson (165 Jane Drive, APN 073-021-090) – Woodside Area

 

Recommendation

Acting as the governing board of the Fair Oaks Sewer Maintenance District (District), adopt a resolution setting a time and place for a public hearing to consider the proposed annexation of the Lands of Upson to the Fair Oaks Sewer Maintenance District.

Your Board authorizing a public hearing to consider the proposed annexation, can result in providing effective sanitary sewer service to a parcel in a suburban area that would otherwise use an “on-site” method to handle wastewater, which could have an impact on neighboring residents.

 

Background

 

Previous Board Action

Entered into an agreement (Agreement) with the Town of Woodside (Town) dated April 2, 1968, to provide for the rights of capacity and use of District facilities for transmission and treatment of sewage from the Town’s Redwood Creek Main Trunk and Glens Collection System Assessment District (Assessment District).

 

History

The Town/District Agreement as described above requires properties within the Town that are proposed to be served by the District to be annexed to the District, and also requires the Town to approve said annexations into the District. The Town executed Resolution 2006-6551 on February 14, 2006, consenting to the proposed annexation of this property.

 

A public hearing to consider an annexation to the District is required pursuant to Section 5838 et seq. of the Streets and Highways Code.

 

Discussion

Linus M. and Jennifer K. Upson, current owners of the property within the Town of Woodside at 165 Jane Drive and identified by Assessor’s Parcel Number 073-021-090, have requested that their property be annexed to the District in order to receive sewer service.

 

We have determined that the property can be served through the facilities of the District, and are recommending that a public hearing be set for your regular meeting of May 23, 2006 at 9:30 a.m., to consider the proposed annexation.

 

A resolution has been approved as to form by County Counsel, and we will post and publish the required notices if your Board adopts the proposed resolution.
