RESOLUTION AUTHORIZING: 1) A WAIVER OF THE REQUEST FOR PROPOSAL (RFP) PROCESS; 2) EXECUTION OF A FOURTH AMENDMENT TO THE AGREEMENT WITH EL CENTRO DE LIBERTAD FOR THE PROVISION OF COURT MANDATED ALCOHOL/DRUG TESTING; AND 3) THE DIRECTOR OF THE HUMAN SERVICES AGENCY TO EXECUTE SUBSEQUENT AMENDMENTS AND MINOR MODIFICATIONS NOT TO EXCEED AN AGGREGATE OF $25,000 AND TO MAKE MINOR CHANGES IN THE TYPE OF SERVICES AND ACTIVITIES PROVIDED UNDER THE AGREEMENT.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on July 1, 2002, the County of San Mateo, Human Services Agency entered into an Agreement with El Centro de Libertad, pursuant to which El Centro de Libertad agreed to provide court mandated alcohol/drug testing for clients referred by Children and Family Services Social Workers for the term of July 1, 2002 through June 30, 2004, for a total Agreement obligation of $17,788; and

 

WHEREAS, this Agreement has been amended on three previous occasions to increase the amount by a total of $82,000 bringing the total contract obligation to $99,788 and extending the term to June 30, 2007 for the purpose of continuing court mandated alcohol/drug testing for clients; and

 

WHEREAS, the extension of this Agreement to June 30, 2007 was authorized by the County Manager’s office in response to an RFP conducted prior to the Second Amendment in May 2004; and

 

WHEREAS, the Human Services Agency wishes to further amend the Agreement to increase the amount by $31,000 for the fourth year of the five year Agreement bringing the total contract obligation to $130,788 for the continuation of court mandated alcohol/drug testing for clients for FY 2005-06 and FY 2006-07; and

 

WHEREAS, the Board is being asked to waive the RFP Process in regards to the Fourth Amendment, as an RFP was conducted in May 2004 and a new RFP is planned for FY 2007-08, and in addition authorize the Human Services Agency Director to execute subsequent amendments and minor modifications not to exceed an aggregate of $25,000 and to make minor changes in the type of services and activities provided under said Agreement; and

 

WHEREAS, the Board agrees that it is in the best interest to waive the RFP process because El Centro de Libertad was previously selected to provide services through June 30, 2007 pursuant to an RFP conducted in May 2004, and the Board has been presented with a form of Fourth Amendment to the Agreement which will add $31,000 in funding to the Agreement as a result of increased referrals and an increased frequency in testing, and the Board has examined and approved same as to both form and content and desires to enter into the same.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

1) The RFP be waived in regards to the Fourth Amendment; and

2) The President of this Board of Supervisors is hereby authorized and directed to execute said Fourth Amendment to the Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signature thereto; and

3) The Director of the Human Services Agency is authorized to execute subsequent amendments and minor modifications not to exceed an aggregate of $25,000 and to make minor changes in the type of services and activities provided under said Agreement.
