BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION (1) AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE CALIFORNIA SECRETARY OF STATE FOR GRANT FUNDING UNDER THE HELP AMERICA VOTE ACT (HAVA) TO PURCHASE AND DEPLOY VOTING SYSTEMS, IN AN AMOUNT NOT TO EXCEED $4,569,941; AND (2) AUTHORIZING THE CHIEF ELECTIONS OFFICER TO EXECUTE RELATED AGREEMENTS AND DOCUMENTS AS MAY BE NECESSARY TO FULFILL DUTIES UNDER HAVA

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the United States Congress has appropriated funding for the Help America Vote Act of 2002 (HAVA); and

WHEREAS, the California Secretary of State has been delegated the responsibility for the administration of the HAVA funds, setting up necessary procedures for allocation of those funds; and

WHEREAS, said procedures established by the California Secretary of State require the County to certify by resolution the approval of applications and contracts before submission of said applications and contracts to the California Secretary of State; and

WHEREAS, the County of San Mateo is eligible for reimbursement funding in an amount not exceed $4,569,941 for the purchase and deployment of voting systems that comply with HAVA’s mandated voting system standards;

WHEREAS, this Board approves the execution and filing of applications and contracts for the purpose of fulfilling duties and responsibilities to be funded from funds provided under HAVA: and

WHEREAS, there has been presented to this Board for its consideration and acceptance an Agreement between the County of San Mateo and the California Secretary of State, reference to which is hereby made for further particulars, and the Board of Supervisors has examined and approved the same as to form and content and understands the terms of said Agreement and certifies that the County understands the assurances and certifications therein and, and desires to enter into the same; and

IT IS HEREBY DETERMINED AND ORDERED that the President of the Board of Supervisors is authorized and directed to execute said Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.

IT IS HEREBY FURTHER DETERMINED AND ORDERED that the County’s Chief Elections Officer or his designee is hereby authorized and appointed to negotiate, execute and submit all subsequent amendments and minor modifications to said Agreement as shall be directed or permitted by the California Secretary of State, and to execute all related applications, contracts, amendments, claims, and other documents which may be necessary for the execution of duties and responsibilities under HAVA.
