AMENDMENT TO AGREEMENT

BETWEEN THE COUNTY OF SAN MATEO AND

JAMES MEIER, M.D.

FOR OBSTETRICAL/GYNECOLOGICAL SERVICES

 

THIS AMENDMENT TO THE AGREEMENT, entered into this _____ day of _______________, 20_____, by and between the COUNTY OF SAN MATEO, hereinafter called "County," and James Meier, M.D., hereinafter called "Contractor";

 

W I T N E S S E T H:

 

WHEREAS, pursuant to Government Code, Section 31000, County may contract with independent contractors for the furnishing of such services to or for County or any Department thereof;

 

WHEREAS, the parties entered into an Agreement for Obstetrical and Gynecological services on September 13, 2005; and

 

WHEREAS, the parties entered into an Amendment on Agreement for Obstetrical and Gynecological services on January 31, 2006; and

 

WHEREAS, the parties wish to further amend the Agreement to extend the termination date and increase the maximum amount of the contract;

 

NOW, THEREFORE, IT IS HEREBY AGREED BY THE PARTIES HERETO AS FOLLOWS:

   

1.

Section 3.1 Term of the Original Agreement is hereby amended to read as follows:

This Agreement shall commence on July 1, 2005, and shall continue for nine months. Unless sooner terminated, this Agreement shall expire and be of no further force and effect as of the end of business on the 30th day of June 2006.

Section 1.7.6 Compliance with Contractor Employee Jury Service Ordinance is hereby added to the Original Agreement to read as follows:

Contractor shall comply with the County Ordinance with respect to provision of jury duty pay to employees and have and adhere to a written policy that provides that its employees shall receive from the contractor, on an annual basis, no less than five days of regular pay for actual jury service in San Mateo County. The policy may provide that employees deposit any fees received for such jury service with the contractor or that the Contractor deduct from the employees regular pay the fees received for jury service.

   

3.

Schedule B of the Original Agreement is hereby amended to read as follows:

Total payment for services under this agreement will not exceed TWO MILLION TWO HUNDRED TWENTY EIGHT THOUSAND DOLLARS ($2,228,000).

   

4.

All other terms and conditions of the agreement dated September 13, 2005, between the County and Contractor shall remain in full force and effect.
