RESOLUTION AUTHORIZING THE DIRECTOR OF COUNTY PARKS AND RECREATION TO EXECUTE A GRANT AGREEMENT BETWEEN STATE PARKS AND RECREATION AND COUNTY PARKS AND RECREATION AND ANY OTHER SUBSEQUENT DOCUMENTS RELATED TO THE GRANT IN THE AMOUNT OF $106,650 FOR THE MEMORIAL COUNTY PARK MARBLED MURRELET RESTORATION AND CORVID MANAGEMENT PROJECT

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on the evening of September 26, 1998, the tanker Command as it traveled in the southbound traffic lane off the San Francisco and San Mateo County coasts released an estimate 3,000 gallons of intermediate Bunker Fuel (IBF) 380; and

 

WHEREAS, on September 30, 1998, this oil began to wash ashore, largely in the form of scattered tarballs, over 15 miles of beaches, mainly in San Mateo County; and

 

WHEREAS, the Federal government and the State of California reached a settlement with the parties responsible for the Command spill, the terms of which were memorialized in a Consent Decree and reviewed by a U.S. District Court and subject to public comment prior to being enter by the Court on March 31, 2000; and

 

WHEREAS, the natural resources damages portion of the settlement, together with interest earned on the entire settlement amount while held in escrow pending final Court approval of the settlement, was deposited into the Natural Resource Damage Assessment; and

 

WHEREAS, the U. S. Fish and Wildlife Service (USFWS), National Oceanic and Atmospheric Administration (NOAA), California Department of Fish and Game (CDFG), California State Lands Commission (CSLC), and California State Parks are Trustees for the natural resources injured by the spill and authorized expenditure of the Natural Resource Damage Money for restoration projects, and

 

WHEREAS, a Restoration Fund was created and California State Parks will act as the administrator for a portion of those funds in the amount of $106,650 to be granted to County Parks for a Memorial Park Marbled Murrelet Restoration and Corvid Management Project to be used to provide the services of a project manager, two (2) seasonal interpretive employees, and garbage control improvements.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors adopt this resolution authorizing the Director of County Parks and Recreation to execute a grant agreement between State Parks and Recreation and County Parks and Recreation and any other subsequent documents related to the grant in the amount of $106,650 for the Memorial County Park Marbled Murrelet Restoration and Corvid Management Project.
