RECOMMENDATION:

Adopt a Resolution:

    Authorizing a Second Amendment to the Agreement with Signet Testing Labs, Inc. to provide special inspection and materials testing as required by the California Building Code for the construction of the San Mateo County Youth Services Center, increasing the not-to-exceed fee by $249,950, from $400,000 to $649,950.

This project contributes to the commitment and goal by consolidating youth services in one location in a new state-of-the-art facility to benefit youth, families, staff, and community. Capital Projects is meeting its performance target to manage one project, the Youth Services Center, which is on schedule and within budget.

BACKGROUND:

On November 18, 2003, by Resolution 066349, the County entered into an agreement with Signet Testing Labs, Inc. for $306,629 to provide special inspection and materials testing for the construction of the Youth Services Center. Special inspection and materials testing are required to ensure the design and construction are in compliance with building codes and specifications. On July 12, 2005, by Resolution 067439, Amendment 1 for $93,371 was approved increasing the contract to $400,000.

 

DISCUSSION:

Special inspection and materials testing are purchased on an as-needed basis to meet the requirements of regulations, project specifications and the construction schedule. Unit prices are fixed by contract. The quantity of testing and hourly inspection varies. This amendment is required because of additional time and work caused by weather conditions, out-of-state fabrication of structural steel, multiple contractors, and additional testing required by the structural engineer to confirm field conditions. Multiple contractors are a result of dividing work into package sizes to promote competition by allowing small contractors to bid on the project.

In addition, contractors caused the County to incur $77,594 worth of testing and inspection costs that are attributable to their actions. While the County is responsible for payment to the testing and inspection firm, it is independently seeking recovery of this amount from the contractors.

 

FISCAL IMPACT:

The project budget is $148,203,000. This project is funded by the sale of lease revenue bonds and a Federal grant. This action does not affect the project budget.
