Agreement with the State Employment Development

Department to Provide Wage and Employment History Data

 

RECOMMENDATION:

Adopt a Resolution authorizing the President of the Board to execute an Agreement with the State Employment Development Department (EDD) to provide Revenue Services with wage and employment history data on debtors. The term of the Agreement shall be from July 1, 2006 through June 30, 2009.

BACKGROUND:

In June 2003 the County and the State EDD entered into a three-year agreement to provide employment and earnings information to assist Revenue Services with the collection of outstanding debts from the Cal Works program, medical assistance and Food Stamp overpayments for the Human Services Agency. In June 2004, the agreement was amended to allow Revenue Services to utilize the employment and earnings information in connection with its efforts to collect debts for County medical services, and restitution, fines, penalties, assessments and fees owed to the County resulting from state mandate or court order.

The June 2003 agreement extended a relationship that had existed for over fourteen years. This information has been very valuable and cost effective in recovering such debt.

DISCUSSION:

Sections 1095 (e) and (i) of the California Unemployment Insurance Code allows County agencies to obtain wage and employment history information from EDD in order to collect costs of County provided services.

The agreement will assist Revenue Services in recovering costs by providing additional information on debtors to the County. EDD is the only provider of this information.

In reviewing the contract from the State, we observed that their non-discrimination clause does not speak to discrimination due to a person’s sexual orientation. We were informed that the State Attorney General’s Office would not approve changes to the standard language in the EDD agreement. We understand that the State non-discrimination language is not consistent with the County standard; however, this information is used to assist with the collection efforts of the Revenue Services Division. In addition, the EDD did not sign the County’s Equal Benefits Declaration form. However, the State does provide benefits to domestic partners.

 

FISCAL IMPACT:

The contract cost is $31 per 1,000 inquires. The maximum amount of this agreement is $5,466.20 which has been included in the FY 2006-07 Recommended Budget.
