Third Amendment to the Agreement with San Mateo County Community College District

 

RECOMMENDATION:

Adopt a resolution:

 

A.

Waiving the Request for Proposal Process (RFP); and

 

B.

Authorizing the execution of a Third Amendment to the Agreement with San Mateo County Community College District for the purpose of administering three new courses: 1) Bio-Manufacturing Quality Control, 2) On-Demand Workshops for graduates of the Bio-Manufacturing Quality Control course, 3) Healthcare Careers Gateway and a spring 2006 session for both the Gateway Program and the Bio-Manufacturing Certificate Program increasing the amount by $277,860, changing the Agreement obligation from $429,970 to $707,830. The term remains the same, January 19, 2004 through June 30, 2006.

*The goals for the bridge program are lower than the bio-Manufacturing Certificate Program because the bridge program targets clients who are significantly more difficult to serve, including foster youth and adults with multiple barriers. The targets are aligned with the grant performance requirements.

** There is no actual data for the Bio-Manufacturing Quality Control or the Healthcare Careers Gateway Program as there were no classes in FY 2004-05.

 

BACKGROUND:

The San Mateo County Workforce Investment Board (WIB) identified a growing need for workers in the field of biotechnology and submitted a proposal for Bay ABC Grant funds. The Bay ABC Grant awarded funds to the WIB to provide biotechnology career training to dislocated workers. On September 9, 2003, the Board of Supervisors accepted funding from the Bay ABC Grant by Resolution Number 66252 on behalf of the WIB. Additionally, this Resolution authorized the Human Services Agency Director to enter into an Agreement with subcontractors identified by the grant. The San Mateo County Community College District was identified by the Bay ABC Grant as a provider of the above-referenced biotechnology training.

 

In addition to the Bay ABC Grant award, the WIB has also received awards from the Department of Labor, the Hewlett Foundation and the Walter S. Johnson Foundation. All of these grants have been accepted by the Board of Supervisors and contribute funds towards the services provided by this Agreement.

 

This Agreement has been amended on two previous occasions to increase services as a result of funds from the Department of Labor Biotech Grant (DOL) through Alameda County for the purpose of providing two additional twelve week Bio-Manufacturing Certificate Program sessions and adding The Gateway Program transitioning foster youth and adults in East Palo Alto and Daly City for bioscience, allied health degrees, and college degree/certificate programs.

 

DISCUSSION:

This Third Amendment increases the amount of the Agreement for the purpose of adding three new courses: 1) Bio-Manufacturing Quality Control, 2) On-Demand Workshops for graduates of the Bio-Manufacturing Quality Control course, 3) Healthcare Careers Gateway and a spring 2006 session for both the Gateway Program and the Bio-Manufacturing Certificate Program. Additionally, this Third Amendment adds the contractor employee jury service ordinance language to the Agreement.

 

The Board of Supervisors is being asked to waive the RFP Process for this Third Amendment as San Mateo County Community College District is the preferred provider named in both the Bay ABC Grant and the DOL Grant, and it is in the County’s best interest to contract with San Mateo County Community College District as they are already providing these services. County Counsel has approved this Third Amendment as to form and Risk Management has approved the Contractor’s Insurance for this Agreement. The Agreement includes all provisions that are required by county ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination, equal benefits and jury service policy.

 

FISCAL IMPACT:

This Third Amendment increases the total Agreement obligation by $277,860 changing the amount from $429,970 to $707,830. The term remains January 19, 2004 through June 30, 2006. The total amount for FY 2005-06 is $277,860. Of this amount, $4,952 is funded through Rapid Response; $78,195 is funded through the Department of Labor Biotech grant; $19,266.75 is funded through the Walter S. Johnson Foundation grant, and $175,446.25 is funded through the Bay Area Workforce Collaborative grant. There are sufficient appropriations in the FY 2005-06 Adopted Budget for this Agreement. There is no Net County Cost.
