SUBJECT:

Amendment III to the Agreements with five providers of Home Health and Attendant Care services for FY 2004-2007

 

RECOMMENDATION:

Adopt a resolution authorizing Amendment III to the Agreements with A Warm Embrace; Addus HealthCare, Inc.; American CareQuest, Inc.; Medical Care Professionals; and Nurse Providers Plus, Inc. for home health and attendant care services with no change to the terms, increasing the collective amount by $970,000 for FY 2006-07 for a total of $2,910,000

These agreements contribute to this commitment and goal by assuring the provision of services which help maintain at-risk individuals in a least restrictive setting a division-wide performance measure. With the assistance of the services provided through these agreements we have met this measure as a division.

BACKGROUND:

In January 2004, Aging and Adult Services issued a Request for Proposals (RFP) for a three-year cycle for home health and attendant care services for the term July 1, 2004 to June 30, 2007. Applicant selection was based on the recommendation of a review committee whose evaluation included consideration of specific criteria addressing experience and competence as put forth in the RFP.

 

On September 14, 2004, by Resolution Number 66913, your Board authorized Agreements with Addus HealthCare, Inc., American CareQuest, Inc., Medical Care Professionals, Nurse Providers Plus, Inc., and Nursing Resources in the collective amount of $950,000. The term of these Agreements is July 1, 2004 through June 30, 2007.

 

On October 26, 2004, the Director of the Health Department authorized Agreement 57000-05-D014 with A Warm Embrace in the amount of $20,000 for home health and attendant care services. The term of this Agreement was October 15, 2004 though June 30, 2005.

 

On September 13, 2005, by Resolution No. 67534, your Board authorized Amendment I to the Agreements with these providers for home health and attendant care services incorporating the Agreement with A Warm Embrace into the new resolution, extending its term through June 30, 2007, and increasing the collective amount for FY 2005-06 by $970,000 to $1,940,000 for the term July 1, 2004 through June 30, 2007.

 

Amendment I also authorized the Director of the Health Department to execute subsequent amendments and minor modifications not to exceed an aggregate of $25,000 per agreement and to make minor changes in the types of services and activities provided under the Agreements. On April 13, 2006, the Director of the Health Department approved Amendment II to the Agreements, adding state required language regarding an appeals process and restrictions around lobbying and county required language regarding contractor employee jury service.

 

DISCUSSION:

Aging and Adult Services’ programs using home health and attendant care services under these Agreements include AIDS Case Management, Multipurpose Senior Services Program, Linkages/Respite, Adult Protective Services, Public Guardian, and the Family Caregiver Support Program.

 

Amendment III establishes the contract amount of $970,000 collectively for FY 2006-07 for the continuation of services provided to Aging and Adult Services’ clients, bringing the total collective amount to $2,910,000 with no change to the terms. Nursing Resources is not included in this amendment due to its inability to comply with Risk Management’s insurance requirements.

 

The contractors have assured compliance with the County’s Contractor Employee Jury Service Ordinance, as well as other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits. County Counsel has reviewed and approved the Resolution and Amendments as to form.

 

FISCAL IMPACT:

The term of the Agreements remains July 1, 2004 through June 30, 2007 for Addus HealthCare, Inc.; American CareQuest, Inc.; Medical Care Professionals; and Nurse Providers Plus, Inc., and October 15, 2004 through June 30, 2007 for A Warm Embrace. The maximum the County shall be obligated to pay collectively for these Agreements for FY 2006-07 under a single resolution is $970,000. This funding, which is a combination of state, federal and client (conservatee) funds, is included in the AAS tentatively Adopted FY 2006-07 Budget. There is no impact on the County General Fund as a result of this action. This collective amount of $970,000 added to the current contract amount results in a new collective total of $2,910,000 for the full contract term.
