RESOLUTION AUTHORIZING THE DISTRICT ATTORNEY TO SUBMIT A GRANT APPLICATION TO THE CALIFORNIA OFFICE OF EMERGENCY SERVICES IN THE AMOUNT OF $146,981 FOR THE OFFICE OF THE DISTRICT ATTORNEY’S STATUTORY RAPE PROSECUTION PROGRAM FOR FY2006-07 AND FOR THE MAXIMUM GRANT AMOUNTS AVAILABLE FOR EACH OF FYS 2007-2008 AND 2008-2009 AND TO EXECUTE THE GRANT AWARD AGREEMENT EACH YEAR TO RECEIVE SUCH FUNDS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the County of San Mateo desires to maintain a certain program designated the Statutory Rape Prosecution Program to be funded from funds made available through the Statutory Rape Prosecution Program and administered by the California Office of Emergency Services (hereinafter referred to as OES); and

 

WHEREAS, it is agreed that the State of California and OES disclaim any responsibility for any liability, and that any liability arising out of the performance of its Grant Award Agreement awarding such funds, including civil court actions for damages, shall be the responsibility of the grant recipient and the authorizing agency; and

 

WHEREAS, it is agreed that any grant funds received hereunder shall not be used to supplant expenditures controlled by this body; and

 

WHEREAS, the Office of the District Attorney has applied for such grant funds each fiscal year since FY1998-1999 and intends to continue applying for such funds in future years pursuant to the same OES grant application requirements; and

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED by the Board of Supervisors of the County of San Mateo that the District Attorney of the County of San Mateo is authorized, on its behalf, to submit grant applications to OES for renewal of its Statutory Rape Prosecution grant for FYs 2006-2007, 2007-2008, and 2008-2009, and is further authorized to execute the resulting Grant Award Agreement including any amendments thereof which do not require commitment of County funds. This authorization is given until and through FY 2008-2009 at which time the Office of the District Attorney may request further authorization to apply for such grant monies.
