RESOLUTION AUTHORIZING: A) THE WAIVER OF THE REQUEST FOR PROPOSAL (RFP) PROCESS; B) THE EXECUTION OF FEE FOR SERVICE RATE ALCOHOL AND DRUG TREATMENT AND PREVENTION AGREEMENTS WITH: 1) ASIAN AMERICAN RECOVERY SERVICES; 2) BAART BEHAVIORAL HEALTH SERVICES INC. (BBHS); 3) DAYTOP VILLAGE, INC.; 4) EL CENTRO DE LIBERTAD; 5) FREE AT LAST; 6) THE LATINO COMMISSION; 7) PROJECT NINETY, INC.; 8) PYRAMID ALTERNATIVES; 9) SERVICE LEAGUE OF SAN MATEO COUNTY; 10) SITIKE COUNSELING CENTER; 11) WALDEN HOUSE, INC.; AND 12) WOMEN’S RECOVERY ASSOCIATION, TO PROVIDE ALCOHOL AND DRUG PREVENTION AND TREATMENT SERVICES, FOR THE TERM OF JULY 1, 2006 THROUGH JUNE 30, 2007, IN THE AMOUNT OF $1,263,582; AND C) THE DIRECTOR OF THE HUMAN SERVICES AGENCY TO EXECUTE SUBSEQUENT AMENDMENTS AND MINOR MODIFICATIONS NOT TO EXCEED AN AGGREGATE OF $25,000, AND TO MAKE MINOR CHANGES IN THE TYPES OF SERVICES AND ACTIVITIES PROVIDED UNDER THE AGREEMENT

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance Agreements with: 1) Asian American Recovery Services, Inc.; 2) BAART, Behavioral Health Services Inc., (BBHS); 3) Daytop Village, Inc.; 4) El Centro de Libertad; 5) Free At Last; 6) Project Ninety, Inc.; 7) Pyramid Alternatives; 8) Service League of San Mateo County; 9) Sitike Counseling Center; 10) The Latino Commission; 11) Walden House; and 12) Women’s Recovery Association; for the term of July 1, 2006 through June 30, 2007; and

 

WHEREAS, the maximum aggregate payment obligation for the 12 agreements is $1,263,582, with the 12 providers drawing from a collective pool of funds from seven different sources such as Drug Court Partnership grant funds, Comprehensive Drug Court Implementation grant funds, CSAT HIV Door-to-Treatment grant funds, and Ryan White Care Act funds based on the nature and quantity of services provided as set forth in the agreements.

 

WHEREAS, the Board concludes that it is in the best interest of the County to waive the Request For Proposal (RFP) process with respect to the services to be provided because the providers have a proven record of providing such services for the County and the department is in the process of developing a comprehensive Alcohol and Drug Treatment and Prevention strategic plan, which will provide the priorities and guidelines that will be utilized in the RFP to be issued of the FY 2007-08; and

 

WHEREAS, this Board has been presented with forms of these Agreements and has examined and approved them as to both form and content and desires to enter into these Agreements.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Request for Proposal Process is waived; and

 

BE IT FURTHER RESOLVED that the President of this Board of Supervisors be, and is hereby authorized and directed to execute said Agreements for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and

 

BE IT FURTHER RESOLVED that the Director of the Human Services Agency shall be authorized to execute subsequent amendments and minor modifications thereto during the initial term of these Agreements; however, as to each Agreement, such authority is limited to:

    a) Reducing the County’s maximum fiscal obligation in the event there is a commensurate reduction in the funding received by the County;

    b) Increasing the County’s maximum fiscal obligation in the event there is a commensurate increase in the funding received by the County; however, said increase shall be limited to a total of $25,000 per Agreement; and/or

    c) Modifying the types of treatment services provided by Contractors, as long as the modifications do not increase the County’s maximum fiscal obligation.
