Resolution Relieving O.C. Jones and Sons from their Obligation to Enter into a Contract with San Mateo County, and Awarding and Authorizing Execution of a Contract for Resurfacing of the Runway and Taxiways, Installation of Stopways and Various Other Improvements at the San Carlos Airport with Interstate Grading and Paving, Inc. – (AIP Projects No. 3-06-0210-08 and No. 3-06-0210-09)

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, this Board of Supervisors did, on June 6, 2006, adopt Resolution No. 68042, which resolution adopted the plans and approved the specifications, determined the prevailing wage scales and called for sealed proposals for the resurfacing of the runway and taxiways, the construction of stopways, the installation of automated weather reporting equipment and various other improvements at the San Carlos Airport; and

 

WHEREAS, the Clerk of this Board of Supervisors did, in public on July 11, 2006, at 2:30 p.m., open and examine all sealed proposals that were received in the specified time for the doing of the work referred to in said Resolution No. 68042; and

 

WHEREAS, this Board of Supervisors has caused an analysis of said sealed proposals to be made by the Director of Public Works of the County of San Mateo, and has, in open session, fully reviewed and considered said proposals and the analysis thereof; and

 

WHEREAS, the apparent low bidder, O.C. Jones and Sons Inc., submitted an incomplete bid proposal and has asked to be relieved of their obligation to enter into a contract with the County of San Mateo; and

 

WHEREAS, the lowest responsible bid was submitted by Interstate Grading and Paving Inc., in the amount of Two Million Seven Hundred Twenty-Two Thousand Six Hundred and Six and 00/100ths Dollars ($2,722,606.00) based on an estimate of the amount of work to be done:

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

 

1.

It is to the best interest of the County of San Mateo to relieve O.C. Jones and Sons Inc from their obligation to enter into a contract with the County of San Mateo for the above described work, pursuant to sections 5100 to 5107 of the Public Contract Code, on the basis of their omission of data required at the time of bid.

 

2.

It is to the best interest of the County of San Mateo to award the contract for the Resurfacing of the Runway and Taxiways, the Construction of Stopways, the Installation of Automated Weather Reporting Equipment and various other improvements at the San Carlos Airport to:

 

Interstate Grading and Paving Inc.

128 South Maple Avenue

South San Francisco, CA 94080

 

3.

The County of San Mateo shall enter into a written contract with Interstate Grading and Paving Inc. for the doing of said work, but excluding the work as described in the alternate bids, as required by the plans and specifications therefore adopted and approved by this Board of Supervisors, as hereinbefore mentioned, said plans and specifications being on file in the office of the Director of Public Works of the County of San Mateo.

The President of this Board of Supervisors shall be, and is hereby, authorized and directed, for and on behalf of the County of San Mateo, to enter into said written contract with Interstate Grading and Paving Inc. for the doing of said work, as hereinbefore mentioned and to receive and approve the Faithful Performance Surety Bond and the Labor and Material Surety Bond required to be posted by the said Contractor with the County of San Mateo in connection therewith.

 

5.

All payments to the Contractor be in accordance with the plans, specifications, and other contract documents, based on the Director of Public Works' written estimates of work actually done.

 

6.

Paragraph 4 above notwithstanding, aggregate payments to Contractor shall not exceed the sum of Two Million Seven Hundred Fifty Thousand and 00/100ths Dollars ($2,750,000.00) without this Board's approval.

 

7.

The Clerk of the Board of Supervisors, County of San Mateo, is hereby authorized and directed to attest the signature of the President of this Board of Supervisors to said written contract.
