Resolution Awarding and Authorizing Execution of a Contract for Dredging at the
Coyote Point Marina (County Project No. P12U1 – F36 [315B])

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board of Supervisors did, on July 11, 2006 adopt Resolution No. 068136, which resolution adopted the plans and approved the specifications, determined the prevailing wage scales and called for the sealed proposals for the Dredging at the Coyote Point Marina; and

WHEREAS, the Clerk of this Board of Supervisors did, in public on August 1, open and examine all sealed proposals that were received in the specified time for the doing of the work referred to in said Resolution No. 068136; and

WHEREAS, this Board of Supervisors has caused an analysis of said proposals to be made by the Director of Public Works of the County of San Mateo, and has, in open session, fully reviewed and considered said sealed proposals and the analysis thereof; and

WHEREAS, the lowest responsible bid was submitted by Ghilotti Bros/ Cooper Crane Inc., in the amount of Eight Hundred Eighty-Three Thousand and No/100 Dollars ($883,000.00) based on an estimate of the amount of work to be done; and

WHEREAS, the Marina Fund has sufficient funding to cover a portion of the work described up to an amount not to exceed Eight Hundred Thousand and No/100 Dollars ($800,000.00) without additional approval.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

It is to the best interest of the County of San Mateo to award the contract for the dredging of Coyote Point Marina to:

Ghilotti Bros/ Cooper Crane Inc.

1175 Nimitz Avenue,

Vallejo, CA 94592

2.

The County of San Mateo shall enter into a written agreement with Ghilotti Bros/ Cooper Crane Inc., for the doing of said work as required by the plans and specifications therefore adopted and approved by this Board of Supervisors, as hereinbefore mentioned, said plans and specifications being on file in the office of the Director of Public Works of the County of San Mateo.

On behalf of the County of San Mateo, the President of this Board of Supervisors shall be, and is hereby, authorized and directed to execute an agreement with Ghilotti Bros/ Cooper Crane Inc. for the work described herein, subject to the Department of Public Works receipt and approval of the Faithful Performance Security Bond and the Payment Bond required to be posted by said Contractor in connection therewith.

All payments to the Contractor be in accordance with the plans, specifications, and other contract documents, based on the Director of Public Works’ written estimate of work actually done.

Paragraph 4 above notwithstanding, aggregate payment to Contractor shall not exceed the sum of Eight Hundred Thousand and No/100 Dollars ($800,000.00) without this Board’s prior approval.

6.

The Clerk of the Board of Supervisors, County of San Mateo, is hereby authorized and directed to attest the signature of the President of this Board of Supervisors to said written contract.
