RESOLUTION AUTHORIZING AN AMENDED AGREEMENT BETWEEN
THE COUNTY OF SAN MATEO AND THE PETER & PHYLLIS MARCHI TRUST
TO PROVIDE AFFORDABLE HOUSING AT ONE PARCEL
ON CLOVERDALE ROAD, PESCADERO

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the County and Natalino and Phyllis Marchi entered into an Agreement to Restrict Property, which was required as a condition of County’s approval of Marchi’s subdivision application (SMN 82-14); this Agreement was executed on July 29, 1985, and recorded (Document No. 85118748); and

 

WHEREAS, the County of San Mateo, Natalino & Phyllis Marchi, and the Peter & Phyllis Marchi Trust wished to enter into separate Agreements to provide two long-term affordable housing units at two sites created for that purpose on Cloverdale Road, Pescadero; and

 

WHEREAS, on November 8, 2005, this Board of Supervisors considered and approved two revised Agreements for these properties, but it has become necessary to amend the Agreement on the parcel known as APN 086-050-080 owned by the Peter & Phyllis Marchi Trust to correct an error in the property reference; and

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance an Amended Agreement, reference to which is hereby made for further particulars, whereby the Peter & Phyllis Marchi Trust or their successors in interest, will provide a housing unit for very low, low or moderate income households at APN 086-050-080, Cloverdale Road, Pescadero, throughout the life of the unit; and

 

WHEREAS, this Board has examined and approved said Agreement as to both form and content and desires to enter into same.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute said Agreement for and on behalf of the County of San Mateo, the Clerk of this Board shall attest the President’s signature thereto, and the County Manager, or his designee, is directed to record the executed agreements and all other necessary documents to complete the recordation.
