RESOLUTION A) WAIVING THE REQUEST FOR PROPOSALS PROCESS AND B) AUTHORIZING EXECUTION OF AN AGREEMENT WITH THE CITY OF DALY CITY FOR CUSTODIAL AND MAINTENANCE SERVICES OF THE MIKE NEVIN HEALTH CENTER FOR THE TERM JUNE 1, 2006 TO MAY 31, 2008, IN AN AMOUNT NOT TO EXCEED $395,199.84

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, Ordinance Code Section 2.92.160 authorizes the Board of Supervisors to waive the Request for Proposals process in any situation where the Board of Supervisors determines that the best interest of the county could be served without the necessity of proposals; and

WHEREAS, While the rest of facilities maintenance for San Mateo Medical Center has been transferred to Public Works, the distance to the Mike Nevin Health Center and staffing needs required to provide maintenance make it impractical and costly for Public Works to extend this service to the Mike Nevin Health Center. In addition, there are no known independent contractors in the bay area that provide both maintenance and janitorial services. Contracting with the City is the most cost-effective and feasible way to proceed at this time, therefore, SMMC is requesting that your Board waive the Request for Proposals requirements for the provision of continued custodial and maintenance services at the Mike Nevin Health Center; and

WHEREAS, this Board has determined that the best interest of the county would be served by waiving the Request for Proposals process for the purpose of continuity of custodial and maintenance services at the Mike Nevin Health Center; and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance an Agreement, reference to which is hereby made for further particulars, whereby the City of Daly City shall continue to provide custodial and maintenance services at the Mike Nevin Health Center; and

WHEREAS, both parties now wish to enter into an Agreement to provide custodial and maintenance services for the period June 1, 2006 to May 31, 2008, for a total obligation of $395,199.84; and

WHEREAS, this Board has been presented with a form of the Agreement and has examined and approved it as to both form and content and desires to enter into the Agreement:

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby authorized and directed to waive the Request for Proposals Process and to execute said Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signatures thereto.
