RESOLUTION AUTHORIZING THE SHERIFF TO TOW UNATTENDED VEHICLES PARKED ON CERTAIN COUNTY ROADWAYS PRIOR TO AND DURING

THE NORTH FAIR OAKS COMMUNITY FESTIVAL,

SEPTEMBER 16 AND 17, 2006

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on Sunday, September 17, 2006, the San Mateo County Sheriff’s Office will be hosting a community festival in the North Fair Oaks area, which is located on and near Middlefield Road, between First Avenue and Fifth Avenue, in the unincorporated area of San Mateo County; and

WHEREAS, the festival is expected to include a parade, live entertainment, vendor booths, and activities, and it is projected that it will be attended by approximately 30,000 people; and

WHEREAS, to safely accommodate all the activities planned for the North Fair Oaks Festival, the Sheriff’s Office and the California Highway Patrol have proposed to close of the following part of Middlefield Road and subsidiary roadways to motor vehicle traffic from 10:00 p.m. on September 16, 2006 until 10:00 p.m. on September 17, 2006:

    Middlefield Road: From First Avenue to Fifth Avenue

    Second Avenue: From 380 & 373 Second Avenue, East to Middlefield Road, and From 422 & 445 Second Avenue West to Middlefield Road

    Third Avenue: From 380 & 393 Third Avenue East to Middlefield Road, and from 427 & 428 Third Avenue West to Middlefield Road

    Fourth Avenue: From 348 & 349 Fourth Avenue East to Middlefield Road, and from 421 & 428 Fourth Avenue West to Middlefield Road; and

WHEREAS, the Sheriff’s Office plans to post the necessary signs and to notify the business/residential community at least a week in advance so persons can make alternate arrangements for their vehicles, and so that drivers have plenty of advance notice of the County’s intention to tow; and

 

WHEREAS, the areas upon which parking is prohibited on September 16 and 17, 2006 are clearly marked on the attached map, which map is incorporated by reference as Exhibit A to this resolution; and

 

WHEREAS, Vehicle Code §22651 provides that any peace officer who is engaged in enforcing parking laws and regulations may remove a vehicle whenever any vehicle is parked or left standing where local authorities, by resolution or ordinance, have prohibited parking and have authorized the removal of vehicles, provided that no vehicle may be removed unless signs are posted giving notice of the removal; and

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that from 10:00 p.m. on September 16, 2006 until 10:00 p.m. on September 17, 2006, during the preparations for and the duration of the North Fair Oaks Community Festival, the Sheriff is hereby authorized to remove or to have removed any and all vehicles that are unattended in the following areas:

    Middlefield Road: From First Avenue to Fifth Avenue

    Second Avenue: From 380 & 373 Second Avenue East to Middlefield Road and from 422 & 445 Second Avenue West to Middlefield Road

    Third Avenue: From 380 & 393 Third Avenue East to Middlefield Road and from 427 & 428 Third Avenue West to Middlefield Road

    Fourth Avenue: From 348 & 349 Fourth Avenue East to Middlefield Road and from 421 & 428 Fourth Avenue West to Middlefield Road,

which areas are clearly marked on the map which is attached hereto and incorporated by reference as Exhibit A to this resolution.
