Agreement with AchieveKids

 

RECOMMENDATION:

Adopt a resolution:

1) Waiving the request for proposals process for non-public school-based mental health services for emotionally and behaviorally disturbed children and adolescents;

 

2) Authorizing the President of the Board to execute an agreement with AchieveKids for the period July 1, 2006 through June 30, 2007, for a maximum obligation of $134,200, Net County Cost is $33,949; and

 

3) Authorizing the Director of Health to execute subsequent amendments and minor modifications not to exceed an aggregate of $25,000 and to make minor changes in the types of services and activities provided under the agreement.

BACKGROUND:

For over 14 years Mental Health Services has contracted with AchieveKids for the provision of non-public school-based mental health services for children and adolescents (ages six to eighteen) with various emotional, behavioral, and developmental difficulties.

 

DISCUSSION:

AchieveKids will provide non-public school-based mental health services at the AchieveKids School. Services will include medication assessment and treatment, classroom interventions, individual therapy, group therapy, family therapy, plan development, crisis intervention, and referrals to community services.

 

Mental Health Services is requesting a waiver of the request for proposals (RFP) process for this agreement for non-public school-based mental health services for emotionally and behaviorally disturbed children and adolescents. These youth need mental health services to benefit from their special educational programs, and they cannot be maintained in public school. Children are placed at AchieveKids by local school districts throughout the County. These placement decisions are the result of an Individual Education Program (IEP) team process. The IEP team consists of the parents or guardians and representatives from Mental Health Services and the public school district. Mental Health Services is responsible for providing mental health services for these clients under Government Code, Title 1, Division 7, Chapter 26.5 and is obligated to make payments for mental health services provided to these youth. Mental Health Services contracts with providers of these non-public school-based mental health services who are qualified to provide these services in order to be able to make the required payments for the services.

 

The term of the agreement is July 1, 2006 through June 30, 2007. The agreement has been reviewed and approved by County Counsel and Risk Management. The FY 2005-06 agreement with AchieveKids is currently on the continuing resolution. The contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits.

 

FISCAL IMPACT:

AchieveKids was granted a 3% COLA for FY 2006-07 which is reflected in the agreement maximum of $134,200. It is expected that State and Federal Medi-Cal funds will cover $43,857 of the costs, Individuals with Disabilities Education Act (IDEA) funds along with funding from the State to pay for mandated programs that are not otherwise funded will cover $34,553, and sales tax through realignment will cover $21,841. The Net County Cost is $33,949. Funds for this agreement are included in the tentatively Adopted FY 2006-07 Budget.
