SUBJECT:

Resolution 629-C Approving the Revised Section 8 Administrative Plan and Authorizing the Director of Housing or designee to Make Ongoing Revisions to the Plan as Necessary to Conform with Housing Law and U.S. Department of Housing and Urban Development (HUD) Regulations.

 

RECOMMENDATION:

Adopt Resolution 629-C approving the revised Section 8 Program Administrative Plan and authorizing the Director of Housing or designee to make ongoing revisions to the Plan as necessary to conform with Housing Law and U.S. Department of Housing and Urban Development regulations and transmit the revised plan to HUD.

This action contributes to this commitment and goal by providing information about the housing programs administered by the Housing Authority and how to apply for assistance.

 

BACKGROUND:

The Section 8 Program was enacted as part of the Housing and Community Development Act of 1974, which re-codified the U.S. Housing Act of 1937. The Act has been amended many times and its requirements as they apply to the Section 8 Program are described in and implemented through the Administrative Plan. This revised Administrative Plan replaces the current one that the Board of Commissioners approved on September 28, 2004. Administration of the Section 8 Program and the functions and responsibilities of the Housing Authority shall be in compliance with regulations of the U.S. Department of Housing and Urban Development (HUD) and all Federal, State and local Fair Housing Laws and Regulations.

 

DISCUSSION:

The proposed Administrative Plan incorporates the updates necessary to bring the plan into conformance with current regulations and requirements. In addition to the updates, the text of the Plan has been restructured to make it flow better for ease of use to the reader. It also incorporates Board Policy changes which were approved in the 2006 Agency Plan. Examples of the policy changes are: 1) the admission preference given to victims of natural disasters; and 2) admission preference given to households being relocated to accommodate development of affordable housing on infill sites in the transit corridors.

County Counsel has reviewed and approved the Resolution as to form.

 

FISCAL IMPACT:

There is no Net County Cost associated with this action. All funds necessary to implement the Plan are supplied by the U.S. Department of Housing and Urban Development.
