RESOLUTION: 1) WAIVING THE REQUEST FOR PROPOSALS PROCESS FOR SPECIALTY OUTPATIENT MENTAL HEALTH SERVICES PROVIDED TO CLIENTS WITH PHYSICAL DISABILITIES REQUIRING WHEELCHAIR ACCESSIBILITY AT THE SERVICE LOCATION; 2) AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE AN AMENDMENT TO THE AGREEMENT WITH OMAL BANI SABERI, LCSW, TO INCREASE THE MAXIMUM OBLIGATION BY $80,000 TO A NEW MAXIMUM OBLIGATION OF $105,000 FOR THE PERIOD JULY 1, 2005 THROUGH JUNE 30, 2008; AND 3) AUTHORIZING THE DIRECTOR OF HEALTH TO EXECUTE SUBSEQUENT AMENDMENTS AND MINOR MODIFICATIONS NOT TO EXCEED AN AGGREGATE OF $25,000 AND TO MAKE MINOR CHANGES IN THE TYPES OF SERVICES AND ACTIVITIES PROVIDED UNDER THE AGREEMENT

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, Ordinance Code Section 2.92.160 authorizes the Board of Supervisors to waive the Request for Proposals process in any situation where the Board of Supervisors determines that the best interest of the County could be served without the necessity of proposals; and

WHEREAS, this Board has been asked to waive the Request for Proposals process in order for Mental Health to contract with this provider of specialty outpatient mental health services; and

WHEREAS, this Board has determined that it is in the best interest of the County to waive the Request for Proposals process; and

WHEREAS, both parties now wish to amend the Agreement with Omal Bani Saberi, LCSW, to increase the maximum obligation by $80,000 to a new maximum obligation of $105,000 for the period July 1, 2005 through June 30, 2008; and

WHEREAS, this Board has been presented with a form of the Amendment to the Agreement and has examined and approved it as to both form and content and desires to enter into the Amendment to the Agreement:

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the County requirement for the Request for Proposals process for said amended Agreement is hereby waived; and

BE IT RESOLVED that the President of this Board of Supervisors be and is hereby authorized and directed to execute said amended Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and

BE IT FURTHER RESOLVED that the Director of Health is authorized to execute subsequent amendments and minor modifications not to exceed an aggregate of $25,000 and to make minor changes in the types of services and activities provided under the Agreement.
