RESOLUTION AUTHORIZING EXECUTION OF AGREEMENTS WITH THE
TOWNS OF WOODSIDE AND PORTOLA VALLEY FOR LAW ENFORCEMENT
AND PUBLIC SAFETY COMMUNICATIONS SERVICES FOR A THREE YEAR
TERM FROM JULY 1, 2006 THROUGH JUNE 30, 2009 AND A COMBINED
AMOUNT NOT TO EXCEED $4,546,109

 

    RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that:

 

    WHEREAS, there exists a long-standing contractual relationship between the Towns of Woodside and Portola Valley and the County of San Mateo, whereby the Sheriff’s Office provides law enforcement services and Public Safety Communications provides dispatch services for the two Towns; and

 

    WHEREAS, the Towns of Woodside and Portola Valley have agreed and are desirous that the Sheriff’s Office and Public Safety Communications continue to be the provider of basic law enforcement and dispatch services within their respective Townships for the period of three (3) years, under an Agreement to be renewable for an additional three (3) years through negotiation and further amendment, if desired by both parties and agreed to by both parties; and

 

    WHEREAS, the Town of Portola Valley has determined to separately contract for supplemental traffic services funded by State COPS monies; and

 

    WHEREAS, the Town of Woodside has incorporated supplemental traffic services into one consolidated agreement, but desires the ability to re-negotiate this component of service during the term of the agreement should State funding levels change; and

 

    WHEREAS, both Towns desire that their respective Town administrators and the Sheriff be empowered to renegotiate levels of service and payments for said supplemental traffic services during the three-year initial term of the Agreement, in order to maintain fiscal flexibility to respond to changing State budget circumstances; and

 

    WHEREAS, this Board finds that it is necessary and desirable that Agreements be executed with the Town of Woodside and the Town of Portola Valley, for specified law enforcement and public safety communications services, for a three (3) year period ending June 30, 2009, in the total amount of $2,758,685 for the Town of Woodside and an amount totaling $1,787,424 for the Town of Portola Valley, including the supplemental services; and

 

    WHEREAS, this Board finds it necessary and desirable to authorize the Sheriff of San Mateo County to re-negotiate the level of supplemental State-funded traffic services with either or both Towns, as may be requested by Towns during the Agreement term; and

 

    WHEREAS, this Board has been presented with said Agreements, and has examined and approved them as to both form and content, and desires to enter into same; and

 

    NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED THAT: the President of this Board of Supervisors be, and is hereby authorized and directed to execute three Agreements: 1) for basic and supplemental law enforcement services with the Town of Woodside; 2) for basic law enforcement services with the Town of Portola Valley; and 3) for supplemental law enforcement services with the Town of Portola Valley, for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.
