SIXTH AMENDMENT TO AGREEMENT WITH CARLA KELL-SMITH & ASSOCIATES FOR THE NOISE INSULATION PROJECT IN THE FOURTH QUARTER 1999 STATE 65 dB CNEL NOISE CONTOUR
THIS SIXTH AMENDMENT TO THE AGREEMENT, entered into on this __________________ day of ____________, 2006, by and between the COUNTY OF SAN MATEO, hereinafter called “County,” and Carla Kell-Smith & Associates, hereinafter called “Contractor”;
W I T N E S S E T H:
WHEREAS, pursuant to Government Code, Section 31000, County may contract with independent contractors for the furnishing of such services to or for County or any department/agency thereof; and
WHEREAS, the parties entered into an Agreement for the provision of services as Project Administrator for the Noise Insulation Project in the Fourth Quarter 1999 State 65 dB Noise Contour on May 1, 2001; and
WHEREAS, this Agreement was amended on January 1, 2002 to increase the Agreement amount by $8,991 to include noise insulation for a fifth house and to extend the term to December 31, 2002; and
WHEREAS, on December 31, 2002, this Agreement was amended to extend the term to December 31, 2003; and
WHEREAS, on December 31, 2003, this Agreement was amended to extend the term to December 31, 2005; and
WHEREAS, on January 1, 2006, this Agreement was amended to extend the term to September 30, 2006; and
WHEREAS, on January 24, 2006, this Agreement was amended to add additional funding in the amount of $136,032 to include the noise insulation of the eligible private school and increase the compensation to the consultants for tasks not originally included in the scope of work for the insulation of the five houses in the Country Club Park area; and
WHEREAS, the parties with to amend the Agreement to extend the term to June 30, 2007.
NOW, THEREFORE, IT IS HEREBY AGREED BY THE PARTIES HERETO AS FOLLOWS:
1.	Paragraph 2 is amended as follows:
	Contract Term The term of this Agreement shall be from May 1, 2001 to June 30, 2007 unless terminated earlier by the County.
2.	All other terms and conditions of the Agreement dated May 1, 2001 and amended on January 1, 2002, December 31, 2002, December 31, 2003, and January 1, 2006 between the County and Contractor shall remain the same and in full force and effect.
