SUBJECT:

A RESOLUTION ACCEPTING THE CERTIFICATE OF THE CHIEF ELECTIONS OFFICER AS THE STATEMENT OF THE RESULT OF THE VOTE AS DETERMINED BY THE OFFICIAL CANVASS OF THE NOVEMBER 7, 2006 GUBERNATORIAL GENERAL ELECTION, DECLARING THE PERSON OR PERSONS WHO HAVE FILED DECLARATIONS OF CANDIDACY BE APPOINTED TO CERTAIN OFFICES IN LIEU OF HOLDING AN ELECTION IN ACCORDANCE WITH ELECTIONS CODE §10515, DECLARING THE RESULTS OF CERTAIN MEASURES VOTED ON, AND DECLARING THE PERSONS ELECTED TO CERTAIN OFFICES IN ACCORDANCE WITH ELECTIONS CODE §8203.

 

RECOMMENDATION:

Adopt a resolution accepting the certificate of the Chief Elections Officer as the statement of the result of the vote as determined by the official canvass of the November 7, 2006 Gubernatorial General election, declaring the person or persons who have filed declarations of candidacy be appointed to certain offices in lieu of holding an election in accordance with Elections Code §10515, declaring the results of certain measures voted on, and declaring the persons elected to certain offices in accordance with Elections Code §8203.

All stakeholders, including the diverse population of the jurisdictions, the governing bodies, interested individuals and organizations, and the Elections Division must participate and collaborate in order for a robust public debate to manifest itself in a fair and impartial election.

By working with local officials and stakeholders, and conducting elections with integrity, the Elections Division fosters faith in the electoral system and the outcomes of elections.

The goal is to complete all pre and post unofficial and official canvass processes with certification of the election by the 28 day after Election Day.

 

BACKGROUND:

Elections Code §§10411 and 15300 et seq. authorize and direct the Board of Supervisors and the Chief Elections Officer, within 28 days of an election, to inspect, process, and count all ballots and prepare a certified statement of the result, and to deliver a duplicate of that statement to the Secretary of State and to the chairperson of the county central committee of each political party. Upon acceptance of this statement, Elections Code §15400 authorizes and directs the governing body of the jurisdiction to declare elected or nominated the persons having the highest number of votes for the offices voted on and to declare the results of the election as to each measure (proposition) voted on.

 

DISCUSSION:

On November 7, 2006, the Chief Elections Officer conducted a Gubernatorial General Election. The official canvass and an abstract or Statement of the Vote was completed and certified by the Chief Elections Officer, and is available at the Registration-Elections Division. In the resolution for your adoption, you will declare eleven Superior Court Judges to be elected. In addition, there are also several appointments in lieu of holding elections for the North Coast County Water District, Pescadero Municipal Advisory Council, and the San Mateo County Harbor District. Lastly, the resolution declares that County Measure A failed to receive enough votes for passage.

This resolution has been reviewed and approved by County Counsel.

 

FISCAL IMPACT:

There is no fiscal impact.
