RECOMMENDATION:

Adopt Resolutions:

 

A) Authorizing an Amendment to the Agreement with Carla Kell-Smith & Associates to serve as Project Administrator for the Noise Insulation Project within the Fourth Quarter 1999 State 65 dB CNEL Noise Contour extending the term to June 30, 2007

 

B) Authorizing an Amendment to the Agreement with G. E. Chen Construction for the Noise Insulation Project within the Fourth Quarter 1999 State 65 dB CNEL Noise Contour extending the term to June 30, 2007

BACKGROUND:

On June 27, 2000, the County of San Mateo executed an Agreement with the City and County of San Francisco, by and through the San Francisco Airport Commission, to provide the County of San Mateo with advance funding of $50,000 each to insulate eligible dwelling units located within the unincorporated Country Club Park area, against noise impacts from aircraft operations at San Francisco International Airport. The five eligible dwelling units are located within the Fourth Quarter 1999 State 65 dB CNEL aircraft noise contour. A condition of the Agreement required the County to apply for a federal grant to receive 80% reimbursement of the total insulation costs. The remaining 20% would be provided by the San Francisco Airport Commission. The County submitted the required federal grant application on December 30, 2002.

 

Effective January 1, 2001, the County entered into an Agreement with Carla Kell-Smith & Associates to serve as Project Administrator and to subcontract for the services of an architect, acoustical engineer and hazardous waste specialist. On March 11, 2003 the County awarded an Agreement to G. E. Chen Construction to serve as the construction contractor to install the required acoustic improvements in the eligible five houses.

 

Since that time, the Federal Aviation Administration (FAA) determined that a private school in the Country Club Park neighborhood is also eligible for federal noise insulation funding, and on July 27, 2004 the County accepted a combined Grant Offer from the FAA that provided 80% reimbursement for the houses and the school, now referred to as “eligible properties.”

 

DISCUSSION:

On December 13, 2005 the original Agreement with the San Francisco Airport Commission was amended to include the private school. After an acoustical assessment of the work to be done on the school had been completed and the new windows and doors selected, in June 2006 sale proceedings began to transfer ownership of the school. The purchasers then changed the selection of both the color and material of the 32 windows to be replaced. This new selection of the windows to be fabricated, along with the length of the sale proceedings that are still in escrow, has resulted in a further delay in the completion of the final insulation work, and extensions of the term of the contracts of the Project Administrator and the construction contractor are therefore necessary.

 

County Counsel has reviewed and approved the Resolutions and Amendments as to form.

 

FISCAL IMPACT:

The proposed Amendments extend the term of the Agreements until June 30, 2007 to allow completion of the construction phase of the Noise Insulation Project. There is no Net County Cost associated with these Amendments.
