RESOLUTION AUTHORIZING THE EXECUTION OF A SIXTH AMENDMENT TO THE AGREEMENT WITH CARLA KELL-SMITH & ASSOCIATES FOR THE NOISE INSULATION PROJECT IN THE FOURTH QUARTER 1999 STATE 65 dB CNEL NOISE CONTOUR

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, on May 1, 2001, the County of San Mateo authorized an Agreement (Agreement Number 38000-01-C205) in the amount of $79,134 for the term of May 1, 2001 to October 31, 2002 to serve as Project Administrator for the County of San Mateo Noise Insulation Project within the Fourth Quarter 1999 State 65 dB noise contour to sound insulate four participating houses; and

WHEREAS, on January 1, 2002, the County of San Mateo authorized a First Amendment (Change Order Number 1), to increase the Agreement amount by $8,991 to include noise insulation for a fifth house and to extend the term to December 31, 2002; and

WHEREAS, on December 31, 2002, the County of San Mateo authorized a Second Amendment (Change Order Number 2) to extend the term to December 31, 2003; and

WHEREAS, on December 31, 2003, the County of San Mateo authorized a Third Amendment (Change Order Number 3) to extend the term to December 31, 2005; and

WHEREAS, on January 1, 2006, the County of San Mateo authorized a Fourth Amendment (Change Order Number 4) to extend the term to September 30, 2006; and

WHEREAS, on January 24, 2006, the Board of Supervisors, by Resolution 67782, authorized a Fifth Amendment to increase the amount by $136,032, changing the Agreement obligation from $88,125 to $224,157, to include the noise insulation of the eligible private school and additional work on the five eligible houses in the Country Club Park area; and

WHEREAS, the parties wish to further amend the Agreement by extending the term from September 30, 2006 to June 30, 2007 for the purpose of completing the noise insulation project; and

WHEREAS, the Board has been presented with this Amendment and desires to enter into same.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of the Board of Supervisors is hereby authorized and directed to execute said Amendment to the Agreement for and on behalf of the County of San Mateo; and the Clerk of this said Board shall attest the President’s signature thereto.
